Approving the preliminary plat of Cadillac Condominium on approximately a 0.66 acre tract of land generally located on the south side of 29th Street between McGee Trafficway and Gillham Road. (SD 1093)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
John Eckhardt, City Development explained that the ordinance was for the preliminary plat of Cadillac Condominiums, the project consist of office, commercial and residential units. there will be 59 under ground parking spaces which excess the cities requirements. There will be park land funds dedicated in the amount of $4,400 either to the Union Hill Cemetary or Observation Park. Included is the ordinance request for right of way variance. John, stated that the variance was necessary because the set back was less than the code required and there was no way to enlarge the right of way without impacting other projects in the area or destroying part of the building. Jim Cruse, John Lutgen and Associates, representative for the developer was present.

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0568, rezoning an area of approximately 47.6 acres generally located on the south side of U. S. Highway 40, approximately one-quarter mile east of Phelps Road from District RA to District R-3. (13133-P)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Larry Stice, City Planning, stated that both ordinances 040740 and 040741 deal with a 50 acre parcel of land near US 40HWY and Phelps Rd. There is a lot of construction in that area and there had been some concerns with the impact of additional traffic. However the traffic study did not indicate that the addition projected traffic would have a negative effect on the area. Larry Stice shared a number of photos of housing units similar to the ones that the developer intends to build. The materials and structure are consistent with other construction in the area. Virginia Walsh, City Planning stated that there were sewer issues and traffic issues at Phelps Road she believed that they have been resolved.

Virginia Walsh, City Planning, explained that the project is in the same area as ordinance 040740 & 040741. She indicated that ordinances 040744 and 040745 are related to the rezoning of an acre of land and the lack of sanity sewer connection for the project. The owner/applicant would be unduly impacted if the city would require him to connect to the sanity sewer system nearly a mile from the property. The owner/applicant is required to prove that the septic system he is now using is adequate to sustain the addition of more residential use. Ron Durnell the owner/applicant was present.

Declaring the areas generally located at 2715 Holly Street, 2719 Holly Street, 2909 Holly Street, 2731 Jarboe Street, 2733 Jarboe Street, 1747 Belleview Avenue and 4328 Walnut Street, as blighted and insanitary areas in need of redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Authority law and approving the Urban Renewal Plan for the same, said plan to be known as the Infill Housing and Rehabilitation Urban Renewal Project Area Nos. 249-256.

Larry Stice, City Planning testified that the ordinance would add 8 new infill housing project with the 99 Tax abatement. & single family detached units and a conversion of an apartment building into condominiums. Eminent domain will not be necessary for this project. Gerald Shecktner, resident, was present and stated that he was ask to share concerns with the Committee regarding the project. Bob Long, EDC, added that he had been working with the Westside Housing Association to insure that all parties could support the project.

Travis Kiefer, Public Works, explained that this ordinance is for the plat of Somerset Gardens, near 105th and Charlotte. It would consist of 144 single family units and all the grades, public right of ways and boundaries have been check and found to be acceptable. Staff recommends approval. Brett Cox, John Lutgen stated that the developer has addressed the flooding and storm water drainage issues by adding conditions to collect and redirect water. The storm water detention has not been constructed as yet.

Accepting the recommendations of the Tax Increment Financing Commission as to the Fifth Amendment to the Briarcliff West Tax Increment Financing Plan; approving the Fifth Amendment to the Briarcliff West Tax Increment Financing Plan; and designating an Expanded Redevelopment Area.

Mashih Patel, EDC, explained that this TIF was in Clay County and allows the expansion of the project, change in the land use from commercial to residential and an increase in the budget. The proposed land use change would allow the construction of 263 condominium units. Which resulted in and expansion of the project and the subsequent increase in the budget.

Travis Kiefer, Public Works, stated the ordinance is for the plat of South Kansas City Plaza Office Park. It is located south of 104th St and Holmes Rd. The plat contains 16.7 acres of land. This is a legislative procedure required by the City Charter after the plat has been approved by the CPC and the grades and closures have been checked and approved. There no known opponents to the project. The ordinance general request to rezone from district RA to district C-3a2. Staff recommends approval.

John Eckhardt, City Planning, testified regarding the 353 amendment and the rezoning ordinance for the project to be located near 45th and Main. The proposed plan includes both above ground and below ground parking and the construction of and office building for American Century Investments. Doug Stole,Polsenilli addressed Councilwoman Cooper's question regarding the upper floors of the building. Doug Stole said that it is a secured building and would not lend itself well for public use. American Century deal with confidential material so a restaurant on an upper wouldn't be in the best interest of the developer or it's customers.
