Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 80-11A0030, rezoning an area of approximately 40.6 acres generally located at the southwest corner of Missouri Highway 350 and Bannister Road from District RA (Agricultural) to District R-1a (One-Family Dwellings). Don Gustafson, City Development Department ordinance 970193 and 970194 are companion ordinances. A complete overview was given on each ordinance. Jim Fahrmeier, supports staff's recommendations. Several area residents spoke in opposition of the project. The committee request that a meeting be set-up to allow the residents input of the project. Committee recommends to hold the ordinance for three weeks.

Carrie Flack, City Development gave an overview of the ordinance. The plan is for about 60 acres located at the NE corner of Pleasant Valley Road & I-435. The subdivision will involve 8 phases, 6 phases are already platted. There will be a minor change in the street configuration. City Plan Commission recommends approval. Roger Meyer, Logan & Assoc. concurs with staff's recommendation.

Approving the preliminary plat of Heritage Estates East on a 1.2 acre tract of land generally located at the northeast corner of 11th Street and Olive Street. (SD 0773)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Larry Stice, City Development gave a complete overview of the ordinance. The ordinance will approve a preliminary plan of Heritage Estates East. The ordinance will create five residential lots in District R4 (Low Apartments). The site is currently vacant. The developer plans to construct single family homes on the site. City Plan Commission recommends approval. Don Moore, Land Clearance Redevelopment Authority, concurs with staff's recommendations. Gloria Ambercrombie, Twelfth Street Heritage, said there's has been about $200,000 invested in the area. The buyers are already secured for the homes. Councilmember Bacchus, expressed concerns regarding down zoning. Committee members agreed to sponsor a ordinance to rezone property in the appropriate category.

Larry Stice, City Development Department stated the ordinance approves a special use permit to allow expansion of a telephone exchange. During an inspection by the Codes Administration Department it was found the building was locate in District R2b (residential) zone. There are other alternative to approach to correct the problems. A commitee substitute was submitted. The committee recommends approval of the ordinance.

Approving the development plan submitted by the Good Apple Redevelopment Corporation on a tract of land generally located at 2207 East 74th Street; declaring the area included in such plan to be a blighted area and its redevelopment necessary for the preservation of the public peace, prosperity, health, safety, morals and welfare; authorizing the Director of Finance to enter into a contract with the Good Apple Redevelopment Corporation; and authorizing certain tax abatement within the plan area.

RESOLUTION - Encouraging the Industrial Development Authority to submit all relevant information concerning the residential development known as Hidden Valley 2.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "IMMEDIATE ADOPTION AS A COMMITTEE SUBSTITUTE"
Bob Collins, Assistant City Manager/Director City Planning, stated the resolution was sponsored by Councilmember Swope and is requesting information pertaining to a project with IDA Hidden Valley II. David Bass, 10606 Palmer, trying to get the Tax Credits for Hidden Valley, said he has gone through the necessary steps. Councilmember Bacchus reiterated the Center Planning Development Council have come before the committee concerning the rehabilitation and maintenance of multi family developments and the use of tax credits. If this project goes forward through IDA and bonds issued, there will be no change except to refinance the existing development and putting numbers of dollars back int the project to rehabilitate it. Staff's concerns are the percentage of rehabilitation compared to the overall debt. The resolution will encourage IDA to submit relevant information. Some of the works is already completed. H. Richard Noon, 7180 W. 107th, Overland Park, Kansas, said there is no plan to displace the residents. Approximately $500,000 goes back into the project. The project was financed in 1989 by an out-of-town buyer who walked away from it at the end of 1994. From that time on everything was done that could be done. Because the prior owner didn't put any money into the project it has been run down. Councilmember Glover asked how many units will be tax credits. Mr. Noon answered. Councilmember Bacchus asked about Section 8 subsidy or whether it will stay as a market rate development based upon the residents. A Committee substitute was submitted on the resolution.

Repealing Ordinance No. 961160, passed on September 12, 1996, and authorizing execution of a $14,200,000.00 development agreement with the Housing Development Corporation and Information Center, Inc., and the Westside Industrial Park, L.L.C., for the development and construction of the Westside Industrial Park Project.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "DO PASS"
Mayor Cleaver spoke on behalf of the ordinance. The ordinance will allow the Westside project to go forth. The project will create hundreds of jobs for area residents. An advisory council has been appointed the Westside Business Park. The 108 loan will be repaid back to the city over 20 years in the amount of 7.1 million dollars. Jim Vaughn, Housing Community Development stated the total project cost has been reduced from 16.7 to 16 million dollars. The loan is 20 year mortgage with a three year interest. The project will pay for the interest payments, for the first three years. Hugh Zimmer, 1220 Washington, stated the project will encumber 20 acres of land located 26 & Southwest Blvd. The land is currently owned by Kansas City Terminal Railroad is under contract for sale to HEDC. A environmental study has been completed for the property. Art Ruiz, Chief Executive Officer, HEDC, stated expediting the project will be beneficial to the community. Committee recommends approval of the ordinance.

Mike Bates, Human Relations Department stated restarting the commission is very important. The commission was created in 1991. The commission has broad powers to look at a variety of Human Rights/Human Relations issues within the city limits of Kansas City. Committee recommends to hold resolution for one week.
