John Eckardt, City Planning, testified on behalf of this ordinance. David Pavlich, Aylett Flowers, representing the applicant, who is in agreement with the conditions. Joseph Panijan, applicant, was present to answer any questions from the committee. Rex Pittman, 3619 NW Linden Rd, is inquiring about the floodplain being disturbed. John Eckardt assured it will not be touched at this time. This ordinance will consider approval of a preliminary plat for three single family lots generally south of NW Linden Rd and north of NW 67th Terr, at North Oregon Avenue.

Gary Carter, EDC, stated the police station is in the area but not part of the project area. This ordinance will approve the activation of Project II of the Barry Towne TIF Plan.

This ordinance will vacate the north side of 24th Terr. between Charlotte St and Campbell St, to allow development of a UMKC parking structure.

Travis Kiefer, City Planning, testified on behalf of the investigation that has taken place regarding some issues raised at an earlier meeting. Dick Ringer, Hunt Midwest, addressed the dead tree issue that was raised earlier. The trees will be replaced after November 1, 2005. David Matthews, Lutjen Law Firm, also addressed the light issues that was raised earlier. He stated that the lighting was as minimal level as possible. This ordinance will allow for revised plans for a restaurant and gas/convenience store in addition to the existing commercial development.
