Amending Chapter 10, Code of Ordinances, by repealing Sections 10-106, Extended hours permits, and 10-261, Renewals, and enacting in lieu thereof new sections of like number and subject matter which allow the director to waive gross sales requirements for liquor license establishments impacted by a state of emergency.


SPECIAL COMMITTEE FOR LEGAL REVIEW recommends "DO PASS"
Regulated Industries Division has seen businesses struggling to meet the sales requirements this year due to the ongoing pandemic involving covid-19. The Division processes the renewal of liquor applications in March, July and November annually. There were a handful of businesses renewed their licenses in March and struggled to meet the $125,000.00 minimum requirement to keep their 3:00 a.m. permit or struggled to meet the minimum $200,000.00 of food sales to meet restaurant-bar requirement. These ordinance changes will allow businesses to keep their liquor licenses intact while we continue to deal with the pandemic.

Amending Chapter 70, Code of Ordinances, by adding a new Section 70-42 to establish an administrative adjudication system for parking tickets and other non-moving-city ordinance violations; and establishing an effective date.


SPECIAL COMMITTEE FOR LEGAL REVIEW recommends "DO PASS AS A COMMITTEE SUBSTITUTE"
Code of Ordinances Chapter 70, establishes ordinances related to traffic and vehicles to be a violation of the Code. Missouri law, RSMo Section 479.011(b) allows any home rule city with more than four hundred thousand inhabitants located in more than one county to establish, by order or ordinance, an administrative system for adjudicating parking and other civil nonmoving municipal code violations. Kansas City is a home rule city with more than four hundred thousand inhabitants located in more than one county.

RESOLUTION - Establishing a steering committee to study and recommend ways to effectively implement pre-trial diversions for Municipal Court defendants experiencing mental and substance abuse disorders.

Megan Phannenstiel, Municipal Court, testified on this ordinance. This ordinance will establish a steering committee to study and recommend ways to effectively implement pre-trial diversions for Municipal Court defendants experiencing mental and substance abuse disorders.

Calling an election on November 3, 2020, for the purpose of obtaining public authorization to establish as a City legislative priority in the Missouri General Assembly the pursuit of a state legislative or referendum action that will return Mayor and City Council-led local control to the Kansas City Police Department rather than the current control of the Kansas City Police Department by a committee comprised of four members appointed by the Governor of Missouri and an additional position held by the Mayor of Kansas City; and recognizing an accelerated effective date.
