Calling an election on November 3, 2020, for the purpose of obtaining public authorization to establish as a City legislative priority in the Missouri General Assembly the pursuit of a state legislative or referendum action that will return Mayor and City Council-led local control to the Kansas City Police Department rather than the current control of the Kansas City Police Department by a committee comprised of four members appointed by the Governor of Missouri and an additional position held by the Mayor of Kansas City; and recognizing an accelerated effective date.

Directing the development of a policy that would have as its objective the offering of pre-trial diversions to Municipal Court defendants for at least twenty percent of non-violent ordinance violations.


SPECIAL COMMITTEE FOR LEGAL REVIEW recommends "DO PASS AS A COMMITTEE SUBSTITUTE"
Mayor Quinton Lucas and Jane Brown, Mayor office, testified on this ordinance. The pre-trial diversion programs provide offenders the opportunity to avoid conviction by taking part in a rehabilitative program specific to the citation received. Municipal violation convictions can lead to disadvantages in housing, education and employment. Additionally, municipal violation convictions can burden indigent individuals with additional legal financial obligations and an individual’s inability to pay for a diversion program should not exclude them from participation in diversion program. The City of Kansas City has an interest in ensuring the fair and impartial application of justice, and justice is better served by diverting a percentage of non-violent crimes from formal prosecution. The municipal court already has discretion to offer diversion as an alternative to conviction. Therefore, the City believes it is important to look for ways to reduce the municipal jail population and offering 20 percent of non-violent citations diversion.

RESOLUTION - Requesting that the City Manager develop a performance management reporting dashboard of certain policing statistics and data and requesting that the Kansas City Police Department provide certain relevant information to the City Manager on a recurring basis.

Mayor Quentin Lucas and jane Brown, Mayors office, testified on this Resolution. This legislation request that the City manager develop a statistics reporting dashboard that would provide an easier and more convenient means of extracting relevant data and information.

Amending Chapter 50, code of Ordinances, by repealing Section 50-44, Obstructing or resisting public safety officer, employee or inspector, and enacting in lieu thereof a new section of like number and subject matter, to include a requirement that the prohibited acts be done “knowingly.”


SPECIAL COMMITTEE FOR LEGAL REVIEW recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE, DEBATE"
Tara Kelly, law Department, testified on this ordinance. This ordinance clarifies that any obstruction or resistance of a public safety officer, employee or inspector need be done “knowingly.” The ordinance also removes the metropolitan ambulance services trust and contractors, and replaces them with emergency medical service providers and paramedics.

SPECIAL COMMITTEE FOR LEGAL REVIEW recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE, DEBATE"
Tara Kelly , Law Department, Testified on this ordinance. This ordinance clarifies that the unlawful conduct prohibited is the failure to follow a traffic direction given by one authorized to do so. The ordinance also establishes a warning requirement before a citation can be issued.

 The City Clerk`s Office now has equipment for the hearing impaired for use with every meeting. To check out the equipment please see the secretary for each committee. Be prepared to leave your Driver`s License or State issued Identification Card with the secretary and she will give you the equipment. Upon returning the equipment your license will be returned.
