Authorizing an extension to and through December 31, 2008, of the UtiliCorp United Inc., and now Aquila, Inc., franchise agreement enacted on October 30, 1986, as Ordinance No. 60167, As Amended.


TRANSPORTATION AND INFRASTRUCTURE COMMITTEE recommends "DO PASS"
Bill Geary, Law Department, explained that the ordinance was for the utility franchise with Aquila. The current one has expired and this ordinance seeks to extend it for a brief period as Aquila is being acquired by Great Plains Energy owner of KCPL. Stan Harris, Director of Public Works was unable to attend.

Authorizing the purchase of land and improvements at 11500 N.W. Prairie View Road, Kansas City, Missouri and the expenditure of previously appropriated funds in the amount of $7,000,000.00.

Dorothy Campbell, Law Department, stated that this ordinance and 071235 were companion ordinances dealing with The Oil Spot DBA The Parking Plaza@KCI. The ordinance would allow the purchase ($7,000,000,00) of the parking lost approximately 10.6 acres of land with a 25,000 sq ft building and 6,500 sq ft canopy. The companion ordinance allows and outlines the new lease agreement with The Parking Plaza@KCI.

Authorizing a $44,065.00 Amendment No. 2 to an agreement with Brian Clark & Associates for 2nd Street Streetscape, Project No. 64005007; authorizing the City Manager to expend $44,065.00 from previously appropriated funds for the project; and recognizing an emergency.

This ordinance authorizes the Capital Improvement Management Office to enter into a 2nd Amendment agreement for additional design services for the 2nd Street Streetscape project.

Condemning and taking private property in fee simple for public purposes of widening and improving NW 64th Street, North Gower Drive, and NW 68th Street Right-of-Way and acquiring additional land and easements for: right of way, storm drainage, and grading, and for temporary access for construction purposes; providing for the payment of just compensation therefore; authorizing continued negotiations by the Director of City Development; consenting to the filing of the petition for condemnation by the City Attorney, on behalf of the City; and authorizing the City Clerk to file this ordinance with the Recorder of Deeds in Platte County, Missouri.

Authorizing a lease with The Oil Spot KC, LLC, for an on-airport public parking lot at the Kansas City International Airport; estimating revenue in the KC Airports Fund in the amount of $242,990.00 for four months of lease payments in Fiscal Year 2008; appropriating from the Unappropriated Fund Balance of the KC Airports Fund; and designating requisitioning authority.

Appropriating $363,000.00 from the Unappropriated Fund Balance of the Fund 8360, Customer Facility Charge; authorizing a $330,000.00 Professional Services Contract with Greyhawk North America, LLC for Project No. 62960C21 - Claims Consultant Services for Consolidated Rental Car Facility at Kansas City International Airport; and designating requisitioning authority.

Mark Vanloh, Director of Aviation, along with Mark Jones, City Attorney, explained that there were issues with the contracts that have been addressed for the most part with change orders, however there is an impasse between Walton Construction and several of its subcontractors. Mark Jones, explained that Greyhawk, North America, LLC would come into firm causation and advise the City on the best way to proceed. They would not negotiation.

Enacting a new Section 68.475, Code of Ordinances, entitled “Sales tax – light rail (2033)” to exact new sales taxes totaling 3/8% to be devoted to a light rail system to extend for 25 years from July 1, 2008 until June 30, 2033; enacting a new Section 68.476, Code of Ordinances, entitled “Sales tax – KCATA (2034)” to extend the City’s current 3/8% sales tax used for the purposes of operating, maintaining, equipping and improving a transit system by the Kansas City Area Transportation Authority for Kansas City, Missouri for 25 years until March 31, 2034; providing for submission of this ordinance to the qualified voters of the City for their approval at a special election called for Tuesday, February 5, 2008; authorizing and directing the City Clerk to notify the responsible election authorities of this election; authorizing and directing the City Clerk to notify the Missouri Director of Revenue if the proposal is approved by the voters; and recognizing this ordinance to be an emergency measure.

Rodney Wallace, ROW, testified that the ordinance would allow a condemnation of property for construction and maintenance of trails and streets in the vicinity of Old Santa Fe Road/Trail.

Calling a special election to be held February 5, 2008, for the purpose of presenting a nonbinding question concerning light rail to the voters; authorizing and directing the City Clerk to notify the responsible election authorities of this election; and recognizing this ordinance to be an emergency measure.


TRANSPORTATION AND INFRASTRUCTURE COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE"
Bill Geary, Law Department, commended that law department and committee is at a stand still until the petition is filed and verified. Then the clerk could notify election board. Councilman Johnson suggest that a substitute be written to cover the "in case" of action being taken before the council or committee would meet again.
