He stated that in Boston Heights Subdivision there was not a 110 foot depth and that this ordinance was requesting a waiver. Member Nash wanted to know how this could happen. Member Williams-Neal stated her displeasure with the street and sidewalk improvements in the area. Vicki Noteis, City Development, stated that another meeting with the residents in the area should be held and that the information from said meeting would be reported to the committee.

She stated that she was not informed of the changes to the existing salvage yard and needed to meet with the other residents. Mr. Dennis Robert, Sr., the applicant was present and agreed to meet with the residents in the area.

RESOLUTION - Approving an amendment to the Westport Planning Area Plan, being that part of Kansas City bounded by the 31st Street Trafficway, State Line Road, Ward Parkway and Troost Avenue, by modifying the Land Use Plan and Map for an area of approximately 0.85 acres generally located at the northeast corner of 46th Street and Madison Avenue to recommend "multi-family residential uses - high density" instead of "office uses".

Larry Stice, City Development, was present to discuss this and the companion ordinances. He stated that this plan was not supported by staff, but that CPC had approved. Kathy Hauser, Lathrop and Gage, was present on behalf of the developer, Greystar Development. Mr. Stice stated that R-5 zoning was required and that these ordinances would address the FOCUS plan by remaining consistent with the surrounding area. He stated the property was currently vacant and that it was being down zoned from the original office uses to residential. Jay Thompson, Helix Architect and Design, was present, and stated that he tried to maintain the feel and design of the plaza. Bart Spalding, Greystar, was also present.

RESOLUTION - Expressing support and approval of an application by the EDC Loan Corporation for State of Missouri Neighborhood Assistance Program Development Tax Credits for the purchase of equipment for Birch Telecom, Inc., located in Kansas City, Missouri, and authorizing the Mayor to execute all necessary documents to obtain the tax credits.

Gabe Okafar, City Planning, was present to testify on behalf of this ordinance regarding Birch Telecom. He stated that this request was a no cost to the city. Kathleen Barney, EDC, was present also. Anthony Dennison, Birch Telecom, gave a description of the proposal. He stated that this was a state EDC development and all that was needed was the mayor to sign off on the project. Member Cooper questioned the change and stated that she thought it was the city manager's responsibility not the mayor's. It was further stated that 100 more jobs would be added with the expansion.
