Approving the preliminary plat of Rolling Meadows on approximately a 26.5 acre tract of land generally located on the west side of Norfleet Road at 58th Street. (SD 0893)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "DO PASS"
Don Gustafson, City Planning & Development Department, said the ordinance is a request for a preliminary plat on 26.5 acres located on the west side of Norfleet Road at 58th Street. The plan proposes a 79 single family residential lot and one detention tract. The project will be completed in two phases. The applicant has preferred to contribute money in lieu of parkland dedication. City Plan Commission and staff recommended approval. John Roe, Attorney, 911 Main St. (representing the applicant), gave a summary of discussions that the applicant have had with the neighborhood association. Mr. Roe elaborated on the concerns addressed from the neighborhood regarding the size of the houses, covenant of restrictions, storm water detention and entrance monumentation. Councilwoman Cooper expressed concerns regarding the detention basin. Lee Dixson, Public Works Department, addressed Councilwoman Cooper's concerns. Committee recommended approval of the ordinance.

Lee Dixson, Public Works Department, said the plat is for a 1 lot development located at 39th & Broadway. The developer has complied with all of the requirements. All of the grades and closures have been checked and recommended approval. Dan Cofran, Attorney, concurred with staff's recommendation.

Approving the assignment of certain development rights with respect to Phase 2 of the Brush Creek Redevelopment Project by Jefferson At The Plaza Redevelopment Corporation to Sailor´s Plaza, LLC; releasing Jefferson At The Plaza Redevelopment Corporation as it relates to those certain development rights; and providing for the effective date.

A committee substitute was presented on the ordinance. Ordinance 000306 is a related case. Bob Langenkamp, City Planning & Development, gave background information regarding the ordinance. He stated it will approve the assignment of certain development rights with the respect of Phase II of the Brush Creek Redevelopment Project by Jefferson at the Plaza located at the northwest corner of Brush Creek and Oak. The contract also provides that no assignment of the rights of obligation contained can be released without the approval of the City.
