Lee Dixson, Public Works Department stated that the plat is a one lot development, located west of Blue Ridge Cutoff. The purpose of the plat is to allow a church to construct athletic fields and a parking lot. The church is located in Raytown, Missouri. The athletic fields and parking lot will be in Kansas City, Missouri. The developer has satisfactorily complied with all of the requirements. Committee recommended approval of the ordinance.

Barry Road, approximately 1,200 feet east of N. Troost Avenue, for the purpose of deleting an approximately 0.828 acre tract of land from said preliminary plan. (4460-CP-2)

Councilman Ford stated that the developer and the neighborhood has reached an agreement which is a private covenant between the developer and the homeowner's association. Art Hammon, Eagle Rivers Investment, stated that the agreement is a private covenant that will govern ten lots. A copy of the covenant agreement is place on file in the City Clerk's Office. Carolyn McClure, 1605 NE 82nd Terrace, concurs with staff and the developer, and is pleased that everything could be worked out. Committee recommended approval of the ordinance.

Authorizing the conveyance of approximately 6.83 acres of land in Barry Park in Kansas City, Platte County, Missouri from the City to AB, LLC in exchange for the conveyance of two tracts of land in Kansas City, Platte County, Missouri totaling approximately 121 acres of land from AB, LLC to the City and authorizing the President of the Board of Parks and Recreation Commissioners to execute a commercial real estate contract on behalf of the City in connection with the transaction and directing the City Clerk to file certain documents with the appropriate offices.

Jim Bowers, Polsinelli & White representing A.B. LLC. He thoroughly went over the contract regarding the amendments and made mentioned of what he agreed and disagreed with regarding the contract. Councilman Rowland moved to go into closed session to discuss a legal matter; seconded Councilwoman Cooper. Andy Smith, Southern Platte County Athletic Association, stated that the athletic association will manage and maintain the facility. He also requested that the contract be approved because of the developer's concerns. Alice Wasthworth, 7900 N. Congress Ave., stated that at the time of the election it was promised that two new parks would be created at no cost to the city, she elaborated on the cost that will take place and who will be responsible for paying of utilities and maintenance. She also expressed concerns regarding environmental cleanup/study. Frankie Hawkins, 10020 N.W. Greenhills Road, spoke in opposition of the project and that the contract should be held until certain issues can be worked out. John Thomas, 8708 N. Carson Avenue, testified on behalf of the ordinance. Wayne St. Vincent, 8241 N. Marston, he said there are a lot of unanswered questions. He thought that the ordinance should be held until questions are answered. Councilman Nash made a motion to amend the contract; seconded by Councilman Rowland. Committee recommended approval of the ordinance.
