Funds are coming from the Uptown Theatre area improvement in Council District 2. PIAC funds. Larry Sells, applicant, 3600 Madison, concurs with staff's recommendations.

Lee Dixson, Public Works Department, stated that the plat is for a forty lot residential development located between N. Oak and N. Main. The developer has been required to submit a storm drainage study. All of the grades and closures have been checked and recommended approval. Mike Flower, Aylett Survey, concurs with staff's report.

RESOLUTION - Amending the Line Creek Valley Area Plan by amending the Proposed Land Use Plan and Map for an area of approximately 6.82 acres generally located at the southeast corner of N.W. Barry Road and N. Congress Avenue by changing the recommended land uses from "low density residential uses" to "office and retail commercial uses".

A Second Committee substitute was submitted on the resolution. Virginia Walsh, City Development stated that resolution 991518 and ordinances 991519 and 991526 are companion cases. The resolution will amend the Line Creek area plan. The cases involves about 6.82 acres located at NW Barry Rd & N. Congress. The proposed project will allow approximately 36,5354 sq feet of commercial development including a proposed bank, gas/convenience store, drive in restaurant and other office retail development. In November, the voters approved a proposition that would allow for the city to convey park land without the necessity of competitive bids in exchange for additional park land in other parts the area north of Barry Road. There is some opposition of the project. Residents feel that there will be too much traffic, and the loss of park ground. City Plan Commission recommended approval of the ordinances with certain conditions. Councilman Ford expressed concerns regarding parking spaces and signage. Virginia Walsh, answered Mr. Ford's concerns. Councilwoman Cooper asked if the design and plan went along with the FOCUS plan. Jim Bowers, representing A. B. LLC. stated swap property for two other parcels of land subject to the zoning proecess. He stated that he is prepared to go on with the land swap if the conditions with the zoning are acceptable. He went over the history of the project with the committee. Committee recommended approval of the ordinances.
