Larry Stice, City Planning, testified that the consensus of City staff is that there would need to be some additional water detention for the project to prevent flooding. There was some general discussion on how best to prevent the problem of flooding. The applicant for the project was present and stated that they had conducted a study that indicated that they would not cause additional flooding problems and they requested advancement.

Approving an amendment to the Shoal Creek Valley Community Master Plan in District MPC on approximately a 1,508 acre tract of land generally located south of N.E. 96th Street, north of N.E. 76th Street and Shoal Creek Parkway, east of I-435 and west of N.E. Flintlock Road. (12417-P-7)

John Eckardt, City Planning, explained the rezoning changes for the project. The are would become MPC 6. There was discussion concerning the type and number of drive thru lanes that the project would have and how that would effect the flow of traffic in the area. The applicant stated the he wants to amend the Shoal Creek Valley Community Master Plan in District MPC (Master Planned Community) by revising MPC-6 (Neighborhood Commercial) and MPC-7 (Community Commercial) to allow up to five (5) drive thru facility lanes instead of the previously approved three (3) drive thru facility lanes for uses which allow them. Although this case deals with all proposed MPC-6 land use areas within the entire Shoal Creek Valley area, the site of the subject case is a proposed bank/credit union, proposed for the northwest quadrant of M-152 and NE Flintlock Road. The credit union believes it needs at least five drive-thru lanes (four lanes and an ATM lane) to be competitive. City staff has no opposition to this self-imposed zoning regulation for this master plan.

Patty Noll, City Planning,the area plan supports single-family development up to 8.7 units per acre (5,000 sq. ft. lot). The requested district, R1a, requires a minimum 7,500 sq. ft. lot. Although the intent is to split the ownership into two lots, even a split into three lots would result in parcels of compatible area and lot width of those to the west within Maple Park Place and those proposed to the north. Utilities are available, as Renaissance in the Northland extended water and sewer lines to this applicant’s north property line. Staff recommends approval of this request to rezone 1.25 acre from District RA to District R1a, subject to the conditions.

It is approximately .45 acre tract of land generally located at the southwest corner of Main Street and 2nd Street (200 Main Street). It is one of several existing building conversion in that area that would allow there to be for sale condominuim units in the river market area.

Andy Bracker, Brownfields,stated that the ordinance seeks to appropriate revenue in the amount of $22,097.00 in the General Fund and appropriate it to the 97 EPA Brownfield Grant account of the General Fund. This estimate and appropriation of additional revenue completes the last of a total $600,000 grant assistance awarded by the U.S. Environmental Protection Agency to the City pursuant to federal Cooperative Agreement No. BP 99733701. This grant was initially accepted, estimated and appropriated by the City pursuant to Ordinance No. 961295, and was augmented by additional awards of Brownfield grant funds by EPA that were accepted pursuant to City Ordinance Nos. 981117 and 000793. The purpose is for the procurement of project permit, procurement of supplies and equipment necessary to support Brownfield projects, and allow complete use of all $600,000 in EPA Brownfield grant funds before use of said funds expire on 03/30/05, pursuant to the EPA cooperative agreement, as amended.
