Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0480, rezoning an area of approximately 82 acres generally bounded by 39th Street on the north, Gillham Road and 43rd Street on the south, Kenwood Avenue on the west and Troost Avenue on the east from Districts R-2a (Two-Family Dwellings, Low Density), R-2b (Two-Family Dwellings) and R-4 (Low Apartments) to District R-2a (Two-Family Dwellings, Low Density).

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0485, rezoning an area of approximately 10.3 acres generally located at the northwest corner of N.W. 115th Street and N.W. Prairie View Road from District GP-7 (Agricultural and Low Density Residential) to District GP-2 (General Transient Retail Business), and approving a development plan for the same. (12922-GP)

Larry Stice, City Planning and Development, was present to testify on behalf of this ordinance. He stated that this ordinance would approve The Oil Spot, a facility for 1281 cars at the airport. Howard Wilcott, architect, was on hand to answer questions. Zoe Holmes, Aviation Department, was present to testify on behalf of this ordinance. She stated that the Aviation Department was in agreement with this ordinance as long as the parking permit process with off airport parking was met. Ray Sousley, Ross, Finger and Sousley, was present to testify on behalf of this ordinance. Harvey Flax, Thrifty Car Rental, was present to testify on behalf of this ordinance. He only wanted to be sure that the rules were enforced fairly.

Amending Chapter 39, Code of Ordinances, entitled Arterial Street Impact Fees, by repealing Sections 39-6, Accounting and expenditures, and 39-10, Periodic review, and enacting in lieu thereof new sections of like number and subject matter to provide for the Mayoral appointment of persons to specified committees described therein.

Amending Chapter 50, Code of Ordinances, by repealing Section 50-152, Drinking alcoholic beverages in public place; Chapter 64, Code of Ordinances, by repealing Sections 64-162 through 64-169 of Article V, Obstructions and Encroachments; Chapter 10, Code of Ordinances, by repealing Section 10-312, Special regulations for certain premises and enacting in lieu thereof sections of like number and subject matter and further amending Chapter 10, Code of Ordinances, by adding a new Section 10-130, Sidewalk cafe license.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE"
Mayor Barnes and City Manager, Wayne Cauthen, were present to testify on behalf of this ordinance. Mayor Barnes stated she had visited Denver and that they have lovely outdoor sidewalk cafes. She further stated that this ordinance will create a great atmosphere, like Venice, that could last for 100 years. Mr. Cauthen stated that this was a small step that would be great for downtown. He further stated that this was not done in other cities. Councilmember Fairfield stated that this would put life on the streets of Kansas City. Chairman Nash reminded the committee and the audience that this was a one year trial period and the things that did not work would be re-evaluated in one year. Councilmember Cooper stated that she liked to eat outside and that she had a great experience working with Les Washington on this ordinance. Councilmember McFadden-Weaver praised the ordinance for its vision. Les Washington, Director, Neighborhood and Community Services, stated that this was only in commercial areas, not in residential areas. Bill Diectrich, President, Downtown Council, was present to voice his opinions on this ordinance. Manny Lopez, Manny's Restaurant, was present to testify on behalf of this ordinance. He wanted to make sure that the proper staff would be made available to take care of any problems. He was in favor but wanted zero tolerance for violaters. Mr. Washington stated that the fees from the licenses would generate revenue for new employees. Councilmember Fairfield questioned the insurance liability that would be required. Jeff Hess, Law Department, quoted the section of the ordinance that dealt with insurance. Claude Page, City Development, stated that not ever cafe in the city would be eligible to put tables on the sidewalks. He stated that there must be certain amount of setback and that this was allowable for commercial zoning only. Dennis Carroll, Liquor Ordinance Review Committee expressed his concerns regarding this ordinance. Lee Lambert, citizen, was present to question teenagers stealing beers from open, outdoor tables. He also questioned who would enforce policies after City offices were closed. Mr. Washington stated that the police would also work with the city to ensure enforcement. Judy Hadley, Regulated Industries, was present to testify on behalf of this ordinance. James Taylor, 31 West Dartmouth, was present to testify on behalf of this ordinance, and Tom Davis, 810 West 45th Street, was present to testify on behalf of this ordinance. Mark Brooks, River Market, stated that his boss got tickets for placing tables on sidewalks and was present to gather information on the changes. Rodney Bland, 12th Street Heritage, was present to testify on behalf of this ordinance. Richard Hughes, Convention and Visitors' Bureau, was present to testify on behalf of this ordinance. He read a letter into the record. Also three e-mails on the subject were submitted for the record.

Approving an amendment to a previously approved preliminary plan in District PD/RA, R-4-O (Planned District/Agricultural, Low Apartments) on approximately a 36 acre tract of land generally located on the east side of Wornall Road approximately 180 feet south of Martha Truman Road, for the purpose of deleting an approximately 8 acre tract of land from said preliminary plan. He stated that the 6th District councilmembers had committed $30,000 In-District PIAC funds to help with the flooding issue. John Roe, Sherwin Epstein, was present to testify on the ordinance also. Craig Patterson, 1025 Winchester, was present and stated his opposition to the project. Mary Jo Cofflum, Somerset Valley, was present to give a list of demands from Somerset Valley to help with this project.

He presented the amended development plan and stated that there was no negative impact on traffic and that the green space in this area would be preserved. Dion Walden, City Planning and Development, stated that a substitute would be introduced to add street lights to this plan. David Harrison, OPUS NW, Developer, was present to answer committee questions.
