Virginia Walsh, City Planning, explained that the ordinance would allow the conversion of an existing building from apartments to condomiums. Douglas Stone representative for the development was present.

Virginia Walsh, City Planning, stated that there had been an error in the legal description regarding the districts. The fact sheet indicated that it was 2nd council district and should have been 5th district.

Amending Second Committee Substitute for Ordinance No. 000352 because of the impact fee ordinance by deleting four conditions and amending two others in connection with Pine Groves, a Community Unit Project on an approximately 361 acre tract of land generally located on the west side of N. Hardesty Avenue extending west approximately one mile and approximately one-quarter mile south of N.E. 108th Street extending south approximately 3,650 feet. (12209-CUP-2)

Dion Walden, City Development, testified regarding the project moving in to it's 2nd phase to change the alignment of a proposed street and to add a condition. Jim Bower , attorney for White Goss, expressed reservations to those changes but agreed to comply. Condition 23 was add it states; "That no development shall occur beyond Phase II or an equivalent number of lots as shown on the Community Unit Plan until Shoal Creek Parkway is constructed or Staley Road is improved from the western boundary of the development to N. Woodland Ave".

Council persons Fairfield and Cooper were excused. Council person McFadden-Weaver sponsored the ordinance and explained the ordinance. She shared information about the HUD Act that directed every entity that received HUD funding to establish and maintain a Section 3. This office would be responsible for assuring the participation of minorities and women in development/ownership.

Accepting the recommendations of the Tax Increment Financing Commission of Kansas City as to the First Amendment to the Prospect North Tax Increment Financing Plan and approving the First Amendment to the Prospect North Tax Increment Financing Plan.

Patty Noll, City Development and Mike Burke, King Hershey, explained that the walkability plan was in place for the project known as Renaissance Gardens. The plan include commercial, retail, restaurants and single family and multifamily units. She added that the plan also would relocate an access road to the plan.

Authorizing City Manager to enter into a First Amended and Restated Cooperative Agreement with Tax Increment Financing Commission of Kansas City, Missouri, and Prospect North, L.L.C., in connection with the financing of public improvements related to the Prospect North Tax Increment Financing Redevelopment Plan.
