Interurban Road is a rural two lane road noted for narrow one-lane bridges. The surrounding property is generally rural in character and generally consists of at least 40 acre tracts of land if containing a residence. City records show one existing parcel of land while the legal description submitted by the applicant shows two existing tracts. The drawings of the plat indicate that Tract 2 will have about 8.5 acres and Tract 1 will have about 80.69 acres. The written description on the drawing describes Tract 1 as 80.699 acres resulting from the subtraction of 8.501 acres from 89.2 acres, while Tract 2 will be 8.5 acres resulting from the subtraction of 31.50 acres from 40 acres. It appears that construction began on a house located on Tract 2 when it was originally 40 acres. After construction began it appears that 31.50 acres was conveyed back to the original owners leaving about 8.5 acres for the house. After the 31.5 acres was conveyed back to the original owner, a stop work order was issued after the Department of Codes Administration became aware of the possible zoning and subdivision violation. District GP-7 requires a minimum of 40 acres for the creation of a lot for a single family residence. GP-7 requires this lot size, in part, because these areas are not served by adequate infrastructure for additional housing or other development. This requirement has enabled much of Platte County in the KCIA plan area to be maintained in large ownerships that have provided for the orderly development pattern not always found in other outlying parts of Kansas City. This property is not served by water. William Mann conveyed to Mr. Cannon the original tract. Tract 1 is intended to have a 50 foot front setback line along Interurban Road, 30 foot side setback lines and a 20 foot rear setback along the northern boundary of the property. Tract 2 will be triangular in shape and have a 50 foot front setback line along the street frontage, a 30 foot setback line along the north boundary, and a 20 foot setback line along the eastern boundary. A stream is shown running through the center of both proposed tracts and notes are provided showing the 100 and 500 year flood plains. Both houses are outside the floodplains. A 15 foot sewer easement is shown within the boundaries of the stream flood plains. The extension of NW 136th Street would be located approximately 170 feet north of the proposed property line between the 2 tracts. The Major Street Plan classifies NW 136th Street as a secondary arterial requiring an 80 foot wide right of way. N.W. 136th Street exists approximately mile to the east, terminating at N. Congress Avenue. However, right of way dedication for NW 136th Street is not shown on the preliminary plat. The legal description and ownership information provided by the applicant indicate two existing lots while city records show one existing lot. The City has no record of the legal establishment of those lots by lot split or plat. A stop work order has been issued by the Department of Codes Administration for the house under construction. This preliminary plat would recognize the two lots described by the applicant as existing. District GP-7 requires a minimum of 40 acres for platted lots. This preliminary plat could result in the creation of a non-conforming lot of about 8.5 acres. On July 13, 2004, the Board of Zoning Adjustment granted a variance to the minimum area for a residential lot in District GP-7 in the amount of .58 acres at 5201 NW 126th Terrace and on August 24, 2004 granted a similar variance in the amount of .56 acres at NW 126th Terrace (Tract 2) located about 1 of a mile to the east of the applicants property.
