ORDINANCE NO. 970236
Accepting the recommendations of the Tax Increment
Financing Commission as to the First Amendment to the Civic Mall Tax Increment
Financing Plan; approving the First Amendment to the Civic Mall Tax Increment
Financing Plan; and designating an Altered Redevelopment Area.
WHEREAS, the City Council of Kansas City, Missouri
by Ordinance No. 54556, passed on November 24, 1982, and thereafter amended in
certain respects by Committee Substitute for Ordinance No. 911076, as amended,
passed on August 29, 1991, created the Tax Increment Financing Commission of
Kansas City, Missouri (the "Commission"); and
WHEREAS, on December 8, 1994, the City Council
passed Ordinance No. 941589, which accepted the recommendations of the
Commission as to the Civic Mall Tax Increment Financing Plan
("Redevelopment Plan"), approved the Redevelopment Plan, found the
Redevelopment Area to be a blighted area; designated the Redevelopment Area as
a Redevelopment Area pursuant to the Act; and authorized the Commission to take
all such action as may be needed to effectuate the Redevelopment Plan; and
WHEREAS, the City Council passed Committee
Substitute for Ordinance No. 961441 on November 26, 1996, which directed the
Tax Increment Financing Commission to prepare an amendment to the Civic Mall
Tax Increment Financing Plan, deleting the property bounded by 11th, McGee,
10th and Oak Streets; and
WHEREAS, said Redevelopment Plan, as amended, has
been proceeding, and the Redevelopment Projects described therein remain
necessary to improve the Redevelopment Area, as amended; and
WHEREAS, an amendment to the Redevelopment Plan
entitled "The First Amendment to the Civic Mall Tax Increment Financing
Plan" ("First Amendment") affect the area described therein was
proposed to the Commission; and
WHEREAS, said Commission has been duly constituted
and its members appointed; and, after all proper notice was given, the
Commission met in public hearing and after receiving the comments of all
interested persons and taxing districts closed said public hearing on February
12, 1997 and on February 12, 1997, adopted Resolution No. 2-2-97
("Resolution") recommending that the City Council approve the First
Amendment and designate the area described therein as a Redevelopment Area
under the Act; and
WHEREAS, the intent of the First Amendment is to
alter the boundaries of the Redevelopment Area and to exclude an area therefrom
as directed by the City Council; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. The recommendations of the Commission
concerning the First Amendment as set forth in the Resolution attached hereto
as Exhibit "A" are hereby accepted and the First Amendment, a copy of
which is attached hereto as Exhibit "B", is hereby approved and
adopted as valid.
Section 2. All terms used in this ordinance, not
otherwise defined herein, shall be construed as defined in Section 99.800 to
99.865 of the Revised Statutes of Missouri, as amended (the "Act").
Section 3. The following described area
constituting the Redevelopment Area, as amended, is hereby designated as a
Redevelopment Area pursuant to the Act:
Beginning at the point of intersection of the
centerline of 13th Street and the centerline of McGee Street, thence north
along the centerline of McGee Street to the centerline of 11th Street;
thence east along the centerline of 11th Street to the centerline of Oak Street;
thence north along the centerline of Oak Street to the centerline of 10th
Street; thence west along the centerline of 10th Street to the centerline
of McGee Street; thence north along the centerline of McGee Street to the
centerline of 8th Street; thence east along the centerline of 8th Street to the
centerline of Oak Street; thence northeasterly along the centerline of Oak
Street to the centerline of Admiral Boulevard; thence east along the
centerline of Admiral Boulevard to the centerline of Locust Street; thence
southerly along the centerline of Locust Street to the centerline of 8th
Street; thence east along the centerline of 8th Street to the centerline
of Charlotte Street; thence south along the centerline of Charlotte Street
to the centerline of 9th Street; thence east along the centerline of 9th Street
to the west right of way line of Interstate 70, said point being
approximately 30 feet north of the northerly extension of the west lot line
of Lot 15, Block 6, Peery Place; thence southerly and westerly along the
west right of way line of Interstate 70 to the centerline of 11th Street;
thence west along the centerline of 11th Street to the centerline of
Charlotte Street; thence south along the centerline of Charlotte Street to
the centerline of 12th Street; thence west along the centerline of 12th Street
to the centerline of Cherry Street; thence north along the centerline of
Cherry Street to the centerline of 11th Street; thence west along the
centerline of 11th Street to the centerline of Oak Street; thence south
along the centerline of Oak Street to the centerline of 13th Street;
thence west along the centerline of 13th Street to the point of beginning,
now all included in and a part of the City of Kansas City, Jackson County,
Missouri.
Section 4. The City Council hereby finds that good
cause has been shown for amendment of the Redevelopment Plan, and that the
findings of the City Council in Ordinance No. 941589 with respect to the
Redevelopment Plan is not affected by the First Amendment and apply equally to
the First Amendment.
