Approving an amendment to
the Oak Park North Area Plan by amending the Proposed Land Use Plan and Map for
an area generally bounded by 31st Street on the north, 33rd Street on the
south, Forest Avenue on the east and Troost Avenue on the west, by modifying
the recommended land uses to recommend mixed use (residential/commercial)
instead of retail commercial; for an area generally located on the east side
of Troost Avenue between 33rd Street on the north and 34th Street on the south,
by modifying the recommended land uses to recommend mixed use
(residential/commercial) instead of retail commercial; for an area generally
bounded by 34th Street on the north, Armour Boulevard on the south, Forest
Avenue on the east and Troost Avenue on the west, by modifying the recommended
land uses to recommend mixed use (residential/commercial) instead of retail
commercial; for an area generally located on the northern half of the east
side of Troost Avenue between Armour Boulevard on the north and 36th Street on
the south as well as the southwest corner of Forest Avenue and Armour
Boulevard, by modifying the recommended land uses to recommend mixed use
(residential/commercial) instead of low density residential 0-8 units per
acre; for an area generally located on the east side of Troost Avenue between
38th Street on the north and 39th Street on the south, by modifying the
recommended land uses to recommend mixed use (residential/commercial) instead
of retail commercial; for an area generally located on the west side of
Forest Avenue between 33rd Street on the north and 34th Street on the south, by
modifying the recommended land uses to recommend medium density residential
(9-28 units per acre) instead of retail commercial; for an area generally
located at the northeast corner of 36th Street and Troost Avenue as well as the
east side of Troost Avenue between 36th Street on the north and 37th Street on
the south, by modifying the recommended land uses to recommend medium density
residential 9-28 units per acre instead of retail commercial; and for an
area generally bounded by 37th Street on the north, 38th Street on the south,
Forest Avenue on the east and Troost Avenue on the west, by modifying the
recommended land uses to recommend public/semi-public instead of retail
commercial and public/semi-public. (385-S-5)
WHEREAS, the Oak
Park North Area Plan was approved by the City Council by Resolution No. 47190,
adopted December 16, 1976, as a guide for future development and redevelopment
of the area generally bounded by Troost Avenue, Stadium Drive and Leeds
Trafficway, 31st Street and 39th Street; and
WHEREAS, the Oak
Park North Area Plan was amended on April 13, 1989, by Resolution No. 63760;
was amended on February 13, 1997, by Resolution No. 970096; was amended on June
17, 1999, by Resolution No. 990674; was amended on September 27, 2001, by Resolution
No. 011206; and was further amended on June 6, 2002, by Resolution No. 020562;
and
WHEREAS, after
further review by the City Development Department it has been deemed
appropriate to amend the Oak Park North Area Plan as it affects that area generally
bounded by 31st Street on the north, 33rd Street on the south, Forest Avenue on
the east and Troost Avenue on the west, by modifying the recommended land uses
to recommend mixed use (residential/commercial) instead of retail
commercial; for an area generally located on the east
side of Troost Avenue between
33rd Street on the north and 34th Street on the south, by modifying the
recommended land uses to recommend mixed use (residential/commercial) instead
of retail commercial; for an area generally bounded by 34th Street on the
north, Armour Boulevard on the south, Forest Avenue on the east and Troost
Avenue on the west, by modifying the recommended land uses to recommend mixed
use (residential/commercial) instead of retail commercial; for an area
generally located on the northern half of the east side of Troost Avenue between
Armour Boulevard on the north and 36th Street on the south as well as the
southwest corner of Forest Avenue and Armour Boulevard, by modifying the
recommended land uses to recommend mixed use (residential/commercial) instead
of low density residential 0-8 units per acre; for an area generally located
on the east side of Troost Avenue between 38th Street on the north and 39th
Street on the south, by modifying the recommended land uses to recommend mixed
use (residential/commercial) instead of retail commercial; for an area
generally located on the west side of Forest Avenue between 33rd Street on the
north and 34th Street on the south, by modifying the recommended land uses to
recommend medium density residential (9-28 units per acre) instead of retail
commercial; for an area generally located at the northeast corner of 36th
Street and Troost Avenue as well as the east side of Troost Avenue between 36th
Street on the north and 37th Street on the south, by modifying the recommended
land uses to recommend medium density residential 9-28 units per acre instead
of retail commercial; and for an area generally bounded by 37th Street on the
north, 38th Street on the south, Forest Avenue on the east and Troost Avenue on
the west, by modifying the recommended land uses to recommend
public/semi-public instead of retail commercial and public/semi-public;
and
WHEREAS, public
notice of a hearing before the City Plan Commission was published on July 1,
2002; and
WHEREAS, the City
Plan Commission considered such amendment to the Proposed Land Use Plan and Map
on July 16, 2002; and
WHEREAS, after
all interested persons were given an opportunity to present testimony, the City
Plan Commission did on July 16, 2002, recommend approval of the proposed
amendment to the Oak Park North Area Plan; NOW, THEREFORE,
BE IT RESOLVED BY
THE COUNCIL OF KANSAS CITY:
Section A. That
the sixth amendment to the Oak Park North Area Plan is hereby approved as to
the Proposed Land Use Plan and Map for that area generally bounded by 31st
Street on the north, 33rd Street on the south, Forest Avenue on the east and
Troost Avenue on the west, by modifying the recommended land uses to recommend
mixed use (residential/commercial) instead of retail commercial; for an
area generally located on the east side of Troost Avenue between 33rd Street on
the north and 34th Street on the south, by modifying the recommended land uses
to recommend mixed use (residential/commercial) instead of retail
commercial; for an area generally bounded by 34th Street on the north, Armour
Boulevard on the south, Forest Avenue on the east and Troost Avenue on the
west, by modifying the recommended land uses to recommend mixed use (residential/commercial)
instead of retail commercial; for an area generally located on the northern
half of the east side of Troost Avenue between Armour Boulevard on the north
and 36th Street on the south as well as the southwest corner of Forest Avenue and
Armour Boulevard, by modifying the recommended land uses to recommend mixed
use (residential/commercial) instead of low density residential 0-8 units per
acre; for an area generally located on the east side of Troost Avenue between
38th Street on the north and 39th Street on the south, by modifying the
recommended land uses to recommend mixed use (residential/commercial) instead
of retail commercial; for an area generally located on the west side of
Forest Avenue between 33rd Street on the north and 34th Street on the south, by
modifying the recommended land uses to recommend medium density residential
(9-28 units per acre) instead of retail commercial; for an area generally
located at the northeast corner of 36th Street and Troost Avenue as well as the
east side of Troost Avenue between 36th Street on the north and 37th Street on
the south, by modifying the recommended land uses to recommend medium density
residential 9-28 units per acre instead of retail commercial; and for an
area generally bounded by 37th Street on the north, 38th Street on the south,
Forest Avenue on the east and Troost Avenue on the west, by modifying the
recommended land uses to recommend public/semi-public instead of retail
commercial and public/semi-public A copy of the sixth amendment to the Land
Use Plan and Map of the Oak Park North Area Plan is attached hereto as Exhibit
A and incorporated herein by reference.
Section B. That
the amendment to the Oak Park North Area Plan is consistent and complies with
the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee
Substitute for Resolution No. 971268, and is adopted as a supplement to the
FOCUS Kansas City Plan.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the law have
been given and had.
