ORDINANCE NO. 000650
Authorizing the Director
of City Development to offer for sale a property known as 3410 Troost Avenue in
Jackson County, Missouri.
WHEREAS, all City
departments have been notified that this property is in excess to the needs of
the City and no interest has been expressed in retaining the property for
future public use; and
WHEREAS, the
property was offered for sale but the bids were not acceptable and were
rejected and there is a need to rebid the property; NOW, THEREFORE,
BE IT ORDAINED BY
THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of City Development is hereby authorized to offer for sale by
competitive bid property known as 3410 Troost and being more particularly
described as:
Beginning
at the Northwest corner of Lot 15, Hingston Grove, a subdivision in Kansas
City, Jackson County, Missouri; thence South along the West line of Lots 15,
14, 13, 12 and 11, Hingston Grove (said West line being also the East line of
Harrison Street, as now established, in Kansas City, Jackson County, Missouri),
200 feet to a point on the West line of Lot 11, Hingston Grove, 6.45 feet South
of the Northwest corner of said Lot 11; thence East and parallel to the North
line of said Lot 11, Hingston Grove, 130 feet to a point on the East line of
said Lot 11 (said East line being also the West line of Lot 4, Hingston Grove)
6.45 feet South of the Northeast corner of said Lot 11 (said corner being also
the Northwest corner of said Lot 4); thence South along the West line of Lot 4,
Hingston Grove, 13.55 feet to a point 20 feet South of the Northwest corner of
said Lot 4; thence East and parallel to the North line of said Lot 4, Hingston
Grove, 140 feet to a point on the East line of said lot; thence North along the
East line of Lots 4, 3, 2, and 1, Hingston Grove, and Lots 3 and 2, AMENDED
PLAT OF MOUNT PLEASANT, a subdivision in Kansas City, Jackson County, Missouri
(said East line being also the West line of Troost Avenue, as now established,
in Kansas City Jackson County, Missouri), 230 feet to a point on the East line
of Lot 2, Amended Plat of Mount Pleasant, 16.45 feet North of the Southeast
corner of said lot; thence West and parallel to the South line of said Lot 2,
Amended Plat of Mount Pleasant, 140 feet to a point on the West line of said
lot 16.45 feet north of the Southwest corner of said lot; thence South 16.45
feet to the Southwest corner of said lot; thence West along the North line of
Lot 3, Amended Plat of Mount Pleasant, and the north line of Lot 15, Hingston
Grove, 130 feet to the point of beginning, said land being the land otherwise
described as including the following:
(a) All of Lots 1, 2, 3, 12, 13, 14, and 15,
the North 20 feet of Lot 4 and the North 6.45 feet of Lot 11, all in HINGSTON
GROVE, A subdivision in Kansas City, Jackson county, Missouri and
(b) Lot 3 and the South 16.45 feet of Lot 2,
AMENDED PLAT OF MOUNT PLEASANT, a subdivision in Kansas City, Jackson County,
Missouri.
Section 2. That
the Director of City Development is also hereby authorized, on behalf of the
City, to enter into a Real Estate Contract between the City and buyer,
including provisions that if the buyer fails to obtain a building permit for
the improvements mutually agreed to be constructed on the premises, or fails to
obtain proper rezoning within a reasonable period of time to be mutually agreed
to by the parties, then the contract for sale shall be cancelled and void and
that monies received by the City from the purchase of the property shall be
returned to the buyer.
Section 3. That
preference will be given to bidders who will use the property as a supermarket,
as set forth in a deed restriction and covenant compelling such use for ten
years. A copy of the Covenant is attached hereto and incorporated by
reference.
