ORDINANCE NO. 100907
Amending Committee Substitute for
Ordinance No. 091067 by repealing Sections 3 and 7 and enacting in lieu thereof
new sections of like number and subject matter for the purpose of revising and
increasing the membership of the Kansas City, Missouri Parking and
Transportation Commission as a result of council redistricting.
WHEREAS, the City
Council recently enacted new councilmanic districts with the passage of
Ordinance No. 100858; and
WHEREAS, the Second
District no longer extends south of the Missouri River or into the geographical
area in which the Kansas City, Missouri Parking and Transportation Commission
(“Commission”) operates; and
WHEREAS, those
portions of the Commission’s operating area formerly in the Second District are
now in the Fourth District; and
WHEREAS, the
Commission considered the councilmanic redistricting and believes that it is
appropriate to replace the Second District representation with additional
Fourth District representation given that the Second District no longer extends
into its operating area; and
WHEREAS, the
Commission further believes that additional representation from neighborhood
and business interests would be beneficial to its work; NOW, THEREFORE,
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section 1. That
Committee Substitute for Ordinance No. 091067 is hereby amended by repealing
Section 3 and enacting in lieu thereof a new Section 3 to read as follows:
Section 3. That the Kansas City, Missouri Parking and
Transportation Commission is hereby created and established and shall initially
consist of fourteen (14) members, comprised as follows:
a. One
(1) representative from the Downtown Council, recommended by its president;
b. One
(1) representative from the Crossroads Community Association, recommended by
its president;
c. One
(1) representative from the River Market Community Association, recommended by
its president;
d. One
(1) representative from the 18th & Vine Historic Jazz District, recommended
by its president;
e. One
(1) representative from the Kansas City Area Transportation Authority,
recommended by its general manager;
f. One
(1) representative from the Downtown Neighborhood Association, recommended by
its president;
g. One
(1) representative from the Central Industrial District Association,
recommended by its president;
h. One
(1) City staff member within the Public Works Department, recommended by the
Director of Public Works;
i. One
(1) representative of the City Manager’s Office, recommended by the City
Manager;
j. Four
(4) City councilpersons consisting of one councilperson from the third
district, two councilpersons from the fourth district, and the chairperson of
the City Council’s Transportation and Infrastructure Committee; and
k. One
(1) City staff member within Planning & Development, recommended by the Director
of Planning & Development.
Upon
the recommendation of those individuals specified herein, the members shall be
appointed by the mayor to serve two-year terms. The mayor shall fill any
vacancy on the Commission by appointing a new member, in the same manner as the
original appointment, and the new member shall serve a two-year term. In the
event the mayor opposes any recommendation made hereunder, the person making
the opposed recommendation shall make a substitute recommendation to the mayor.
Section 2. That
Committee Substitute for Ordinance No. 091067 is hereby amended by repealing
Section 7 and enacting in lieu thereof a new section 7 to read as follows:
Section 7. That the
members of the Commission shall select their chairperson from amongst
themselves. Eight members shall constitute a quorum unless the committee shall
elect to provide by motion, duly adopted, that a larger number shall be
required.
Section 3. That
those members previously appointed by the Mayor, with the exception of the
second district councilperson, shall continue to hold their seats for the
duration of their respective terms.
Section 4. That
all other provisions of Committee Substitute for Ordinance No. 091067 not
modified herein shall remain in full force and effect.
