Approving an amendment to a previously approved development plan in District URD (Urban Redevelopment District) on approximately a 7 acre tract of land generally located south of 43rd Street, north of W. 44th Street, east of Madison Avenue and west of Jefferson Street. (10366-URD-10)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District URD (Urban Redevelopment District) on approximately a 7 acre tract of land generally located south of 43rd Street, north of W. 44th Street, east of Madison Avenue and west of Jefferson Street, and more specifically described as follows:

 

TRACT A: Bishop Spencer Place, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, formerly described as follows:

 

TRACT I: Lots 4 through 12, inclusive, Lots 28 through 45, inclusive, Bunker Hill, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, together with that part of the West Half of the Northeast Quarter of Section 30, Township 49, Range 33, lying adjacent thereto being more particularly described as follows: Beginning on the west line of Summit Street at the most southeasterly corner of Lot 29, Block 1, Bunker Hill; thence south along said west line of Summit Street 30 feet to the easterly prolongation of the south line of Lot 28, Block 1, Bunker Hill; thence west to the southeast corner of said Lot 28, Block 1, Bunker Hill; thence north 30 feet to the south line of said Lot 29; thence east along said south line of Lot 29 to the point of beginning; together with the west half of the vacated alley lying adjacent to Lots 4 through 12 and the east half of the vacated alley lying adjacent to Lots 35 through 45; and together with the westerly 30 feet of vacated Summit Street lying adjacent to Lots 29 through 45 and adjacent to the aforedescribed parcel.

 

TRACT II: Lots 1, 2 and 3, S.P. Bucher Resurvey, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, together with the westerly 30 feet of vacated Summit Street lying adjacent thereof.

 

TRACT III: Lots 8 through 13, inclusive, Belleview Place, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, together with the north half of vacated alley lying adjacently thereto.

 

TRACT IV: Lots 7 through 26, inclusive, Block 4, together with the north half of the vacated alley lying adjacent to Lots 7 through 13 and the south half of the vacated alley lying adjacent to Lots 14 through 26; and Lots 14, 15 and 16, Block 5, together with the south half of vacated alley adjacent thereto, Pates Addition to Westport, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, and the north half of vacated 43rd Street Terrace lying adjacent thereto.

 


TRACT V: Lots 2 and 3, Block 1, Bunker Hill, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, together with the west half of the vacated alley lying adjacent thereto.

 

TRACT VI: Lots 1, 2, 3 and 4, except the south 37.5 feet thereof, and Lots 5, 6, 7, 8, 9, 10, 11, 12 and 13 together with the north half of vacated alley lying south of and adjacent to the said Lots 5 through 13 and together with the south half of vacated 43rd Street Terrace lying north of and adjacent to the said Lots 1 through 13, all in Block 5, Pates Addition to Westport, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT VII: The south 37 1/2 feet of Lots 1, 2, 3 and 4, Block 5, Pates Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT B: Lots 17 and 18, Block 5, Pates Addition to Westport, a subdivision in Kansas City, Jackson County, Missouri, and part of Lot 19 described as follows: Beginning at the northwest corner of Lot 19, Block 5; thence south 26.4 feet; thence east 1.4 feet; thence north 26.4 feet; thence west 1.4 feet to the point of beginning; and the south one-half of the vacated alley north of and adjacent; according to the recorded plat thereof.

 

TRACT C: All of Lot 19, except the west 1.4 feet of the north 26.4 feet and the west 15 feet of Lot 20, together with the south one-half of the vacated alley north of and adjacent to said premises, Block 5, Pates Addition to Westport, Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT D: All of the east 10 feet of Lot 20 and all of Lots 21 and 22, in Block 5, in Pates Addition to Westport, a subdivision in Kansas City, Jackson County, Missouri, together with the north one-half and the south one-half of vacated alley north of and adjoining said premises, except that part of the north one-half of vacated alley now platted as Lot 1, Bishop Spencer Place.

 

TRACT E: Lots 23 and 24, together with the south one-half of vacated alley north of and adjacent to said premises, Block 5, Pates Addition to Westport, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT F: Lots 25 and 26, together with the south one-half of vacated alley north of and adjacent to said premises, Block 5, Pates Addition to Westport, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT G: The north one-half of vacated alley lying south of and adjacent to Lots 1, 2, 3 and 4, Block 5, Pates Addition to Westport, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer provide for fire protection as required by the Fire Department.

 

7. That the developer extend, install, loop, remove and/or relocate water mains as required by the Water Services Department.

 

8. That the developer relocate or abandon the existing sewers as required by the Water Services Department.

 

9. That the developer install streetlights on 43rd Street along its frontage as required by the Department of Public Works.

 

10. That the developer contribute $19,439.39 in lieu of parkland dedication for 126 units (126 x 2 x 0.006 = 1.512 x $12,856.74) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

11. That the developer submit a site plan to the Director of City Development for approval prior to issuance of a building permit. The site plans shall include: development plan information, property uses, setback distances, lighting, landscaping, signage (including elevations), and architectural characteristics. The landscaping plan shall identify adequate areas for planting of trees and shrubs.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 020809, which is attached hereto and made a part hereof.

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
