ORDINANCE NO. 120531

 

Approving recommendations from Arterial Street Impact Fee District Advisory Committees; appropriating $868,858.04 in the Arterial Street Impact Fee Fund; authorizing funding agreements with the TIF Commission and the City of Gladstone for public improvements; and designating requisitioning authority.

 

WHEREAS, on April 18, 2012, the District D Advisory Committee recommended allocating $350,000.00 towards N. Arlington Avenue from Missouri Route 210 to N.W. Derrough Drive; and

 

WHEREAS, on April 18, 2012, the Impact Fee District D Advisory Committee recommended allocating $163,847.00 and in FY2013 Council District 1 allocated $100,000.00 of PIAC funds for improvements to Pleasant Valley Road; and

 

WHEREAS, on May 16, 2012, the Impact Fee District B Advisory Committee recommend allocating $355,010.38 for Shoal Creek Parkway from Oak to Harrison;

 

WHEREAS, on December 14, 2000, the City Council passed Ordinance No. 001638 which established the Parvin Road Corridor Tax Increment Financing Plan which provides for, among other things, the design and construction of certain roadways; and

 

WHEREAS, the Parvin Road Corridor Tax Increment Financing Plan was subsequently amended with Ordinance Nos. 010360, 070412, 090261, 090544, 100165, 120173 and includes improvements to N. Arlington Avenue; and

 

WHEREAS, the City of Gladstone has committed funds for improvements to Pleasant Valley Road which requires relocating the street within Kansas City; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the recommendations of the Arterial Street Impact Fee Committees for project allocations in the Impact Fee Districts are hereby approved.

 

Section 2. That the sum of $868,858.04 is hereby appropriated from the Unappropriated Fund Balance of the Arterial Street Impact Fee Fund to the following accounts in the Arterial Street Impact Fee Fund:

 

13-2430-897124-B-89008243 N. Arlington $350,000.00

13-2430-897124-B-89008060 Pleasant Valley Road 163,847.66

13-2430-707287-B-70132358 Shoal Creek Parkway 350,000.00

13-2430-897287-B-89008191 Shoal Creek Parkway 5,010.38

TOTAL $868,858.04


Section 3. That the Director of Public Works is hereby authorized to execute a public infrastructure funding agreement with the Tax Increment Financing Commission for the design of street improvements to N. Arlington Avenue from Route 210 to N.W. Derrough Drive. The agreement is approved in substantial form as that on file in the office of the Director of Public Works, subject to the receipt of all required approvals, from funds in an amount not to exceed $350,000.00, appropriated in Account No. 13-2430-897124-B-89008243 for the financial obligations contained in the agreement.

 

Section 4. That the Director of Public Works is hereby authorized to execute a public infrastructure funding agreement with the City of Gladstone, Missouri for Pleasant Valley Road. The agreement is approved in substantial form as that on file in the office of the Director of Public Works, subject to the receipt of all required approvals, from funds in an amount not to exceed $263,847.66 appropriated in Account Nos. 13-2430-897124-B-89008060 and 13-3090-898101-B-89008060 for the financial obligations contained in the agreement.

 

Section 5. That the Director of Public Works is designated requisitioning authority on Account Nos. 13-2430-897124 and 13-2430-897287.

 

Section 6. That the Director of Parks and Recreation is designated requisitioning authority on Account No. 13-2430-707287.
