ORDINANCE NO. 020886

 

Amending Ordinance No. 56908 by repealing Section A, and enacting a new Section A, in connection with a Community Unit Project on a 42 acre tract of land located on the north and south sides of N.E. Parvin Road at N. Bellaire, ( 6018-CUP-1), by deleting condition number 5 contained therein and inserting a new condition number 5.

 

WHEREAS, on September 13,1984, the Council approved a Community Unit Project on a 42 acre tract of land generally located on the north and south sides of N.E. Parvin Road at N. Bellaire, (6018-CUP-1) by Ordinance No. 56908, (Community Unit Project), that included a certain condition that required the developer to make certain roadway improvements to N.E. Russell Road; and

 

WHEREAS,  the Public Works Department has determined that this development will not generate an additional amount of traffic that would require the developer to construct the improvement; and

 

WHEREAS, the Public Works Department, the City Development Department and the developer have determined that it is appropriate and in the best interest of the City to modify certain conditions specified in Ordinance No. 56908 for the Community Unit Project; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That in connection with a Community Unit Project on a 42 acre tract of land located on the north and south sides of N.E. Parvin Road at N. Bellaire, (6018-CUP-1), Ordinance No. 56908 is hereby amended by repealing Section A and enacting in its place a new Section A, to read as follows:

 

Section A. That a Community Unit Project Plan on a 42 acre tract of land located on the north and south sides of N.E. Parvin Road at N. Bellaire, and more specifically described as follows:

 

All the following tract located in the Southwest Quarter of Section 4, and the Southeast Quarter of Section 5, both sections being in Township 50, Range 32, Kansas City, Clay County, Missouri: Beginning at the southwest corner of aforesaid Section 4; thence South 89E21'09" East, along the south line of Section 4, 1310.65 feet to the east line of the Southwest Quarter of the Southwest Quarter of said Section 4; thence North 0E31'02" East, along said east line, 1320.10 feet to the northeast corner of the aforesaid Quarter-Quarter Section; thence North 89E28'49" West, along the north line of the aforesaid Quarter-Quarter Section, 50.00 feet; thence North 50E17'10" West, 395.60 feet; thence North 89E28'49" West, 429.80 feet; thence South 68E58"43" West, 390.39 feet; thence North 89E28'49" West, 160.00 feet to the west line of said Section 4; thence South 0E33'48" West, along said west line, 6.39 feet; thence North 89E26'38" West, and parallel to the north line of the Southeast Quarter of the Southeast Quarter of aforesaid Section 5, 240.00 feet; thence South 0E33'48" West, 444.56 feet; thence South 89E26'38" East, 240.00 feet to the west line of Section 4 (also the east line of Section 5); thence South 0E33'48" West, along the aforesaid section line, 972.89 feet to the point of beginning, excepting that part in Parvin Road.

 


is hereby approved, subject to the following conditions:

 

1. That the developer provide an internal water distribution system to serve each living unit and that the developer consider the location and depth of the existing 36 inch water main in N.E. Russell Road for any improvements to said road.

 

2. That the developer pay money in lieu of parkland dedication to the City in the amount of $30,980.00 (Phase II, at the rate of 1.2 acres at $11,306.57 and Phase III in the amount of 2.088 acres at $19,674.43).

 

3. That the developer plat the area in phases in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

4. That the developer submit a drainage study based upon a 5, 10 and 25 year design flood and plans for detention basin, if required.

 

5. That the developer dedicate 30 feet of right of way from the centerline on N.E. Russell Road.

 

6. That the developer construct a sidewalk along the west side of N. Bellaire between Parvin Road and Russell Road and along the south side of N.E. Parvin Road, west of Bellaire.

 

7. That the developer contribute for the improvement of one-half of residential street and sidewalk for Searcy Creek Parkway located north of N.E. Parvin Road.

 

8. That the developer extend sanitary sewers and provide separate sanitary sewer connections for each townhouse unit.

 

9. That the developer of Phase III construct a sidewalk along the north side of N.E. Parvin Road.

 

Section 2. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove as required by the Zoning Ordinance all public notices were given and all hearings were held.
