Authorizing the Director of Water Services Department to enter into a $4,246,000.00 contract with MEGA Industries Corporation for Contract No. 1036, Project No. 81000537, Middle Blue River Green Solutions Pilot Project – BMP Installation; authorizing expenditures of $4,496,000.00 from previously appropriated funds; and authorizing the Director of Finance to return unexpended appropriations to the appropriate account.




Section 1. That the Director of Water Services Department is hereby authorized to execute, on behalf of Kansas City, Contract No. 1036, Project No. 81000537, with MEGA Industries Corporation which will consist of construction of Stormwater Best Management Practices in the Middle Blue River Basin in conjunction with the Overflow Control Plan for the Water Services Department of Kansas City Missouri. This project is required by the consent decree with the Environmental Protection Agency.  A copy of the contract is on file in the office of the Director of Water Services.


Section 2. That the Director of Water Services is hereby authorized to charge up to $370,000.00 for project management costs associated with this project. 


Section 3. That the Director of Water Services is authorized to expend up to the sum of $4,496,000.00, from funds previously appropriated to Account No. AL-8183-808085-B-611060- 81000537, Water & Sewer CD5, including contingencies, to satisfy the cost of this contract.


Section 4. That upon completion of this contract, the Director of Finance is hereby authorized to return the unexpended portion of this appropriation to the Unappropriated Fund Balance from which it was derived.




I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
