Approving an amendment to a development plan in District GP-6
on a 22.2 acre tract of land generally located at 2001 N.W. 87th Terrace. (6625-GP-8)
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section A. That an
amendment to a development plan in District GP-6 (Low Density Residential) on a
22.2 acre tract of land generally located at 2001 N.W. 87th Terrace, and more
specifically described as follows:
Tract
I: All of Tracts A and B, Barry Middle School, a subdivision in Kansas City,
Platte County, Missouri, except all that part of Tract A, Barry Middle School,
subdivision of land in the Northeast Quarter of Section 9, Township 51, Range
33, Kansas City, Platte County, Missouri, being described as follows:
Beginning at the Northeast corner of the Northeast Quarter of said Section 9;
thence South 0 degrees 31 minutes 15 seconds West (Plat - South 0 degrees 29
minutes 44 seconds West), along the East line of said Tract A, 30.00 feet to a
point on the Northerly line of Northwest 87th Street Terrace, as now
established; thence North 89 degrees 35 minutes 33 seconds West (Plat - North
89 degrees 36 minutes 52 seconds West), along said Northerly right of way line,
264.06 feet; thence North 0 degrees 24 minutes 39 seconds East, 30.00 feet to a
point on the North line of said Tract A; thence South 89 degrees 35 minutes 33
seconds East (Plat - South 89 degrees 36 minutes 52 seconds East), along said
North line, 264.12 feet to the True Point of Beginning. Also except all that
part of Tract B, Barry Middle School, a subdivision in the Northeast Quarter of
Section 9, Township 51, Range 33, Kansas City, Platte County, Missouri, being
described as follows: Commencing at the Northeast corner of said Barry Middle

School, 80.00 feet to the True Point of Beginning of the tract to be herein

Tract II: All that
part of the fractional Northwest Quarter of Section 10, Township 51, Range 33,
Kansas City, Platte County, Missouri, being described as follows: Commencing at
the Northwest corner of said fractional Northwest Quarter; thence South 0
degrees 31 minutes 15 seconds West, along the West line of said fractional Northwest
Quarter, 347.24 feet to the True Point of Beginning of the tract to be herein
described; thence continuing South 0 degrees 31 minutes 15 seconds West, along
said West line, 635.50 feet; thence South 89 degrees 28 minutes 45 seconds
East, 145.20 feet; thence South 0 degrees 31 minutes 15 seconds West, 82.30
feet; thence South 65 degrees 36 minutes 05 seconds East, 260.18 feet; thence
North 0 degrees 16 minutes 15 seconds East, 70.62 feet; thence North 36 degrees
36 minutes 15 seconds West, 29.50 feet; thence North 0 degrees 31 minutes 15
seconds East 282.04 feet; thence Northwesterly, along a curve to the right,
having an initial tangent bearing of North 54 degrees 12 minutes 20 seconds
West, a radius of 430.00 feet, an arc distance of 131.12 feet; thence North 36
degrees 44 minutes 03 seconds West, 447.76 feet to the True Point of Beginning.
is hereby approved, subject to
the following conditions:
1. That the developer cause the area to be platted and processed
in accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2. That the developer construct a sidewalk/trail connection to N.W. Old Stagecoach Road in conformance to AASHTO design standards to allow pedestrian and
bicycle access to the school property.
3. That the developer submit a macro/micro storm drainage study
to Development Services for review and acceptance for the entire development
when the first plat is submitted, and that the developer construct any
improvements as required by Development Services.
4. That the developer obtain the grading consents, and all
grading, temporary construction and drainage/sewer easements from the abutting
property owner prior to submitting any public improvements.
5. That the developer subordinate to the City all private
interest in the area of any right-of-way dedication as required by Development
Services, and that the developer be responsible for all costs associated with
subordination activities.
6. That adequate sight distance be provided for each drive
connection to N.W. 87th Terrace as required by Development Services.
7. That the developer secure permits to repair existing or
reconstruct sidewalks, curbs, gutters, storm sewers, and streetlights as
necessary along all development street frontages, or submit a letter from a
Missouri licensed civil engineer stating that the sidewalks, curbs, and gutters
are in a good state of repair and meet the requirements set forth in Chapters
56 and 64, Code of Ordinances, as required by Development Services, prior to
recording the plat.
8. That the developer submit plans for grading, siltation, and
erosion control to Development Services for approval and permitting prior to
beginning any construction activities.
9. That the developer secure a land disturbance permit from
Development Services prior to beginning any construction, grading, clearing, or
grubbing activities, if the disturbed area equals or exceeds one acre.
10. That the developer grant a surface drainage easement to the
City as required by Development Services on the final plat.
11. That the developer grant a BMP easement to the City as
required by Development Services on the final plat.
12. That the developer grant a tree preservation easement to the
City, as required by Development Services, and show easement on the final plat.
13. That the developer submit covenants, conditions and
restrictions to Development Services for review by the Law Department for
approval for the maintenance of private open space and enter into a covenant
agreement for the maintenance of any stormwater detention area tracts.
14. That the developer submit a final plan for each phase to the
City Plan Commission for approval, including detailed information on landscaping,
grading, lighting (including a photometric study showing zero footcandles at
the property lines and direct illumination beyond property lines), signage
without LED display or changeable copy (including elevations), and building
and sign elevations.
A copy of said development plan
is on file in the office of the City Clerk with this ordinance and is made a
part hereof.
Section B. That the
Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
