ORDINANCE NO. 990189
Approving an amendment to a previously approved
preliminary plan in District CP-3 (Regional Planned Business Center) on
approximately a 6.8 acre tract of land generally located on the west side of N.
Broadway Avenue, approximately 150 feet south of N.W. 71st Street. (8063-CP-5)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That an amendment to a
previously approved preliminary plan in District CP-3 (Regional Planned
Business Center) on approximately a 6.8 acre tract of land generally located on
the west side of N. Broadway Avenue, approximately 150 feet south of N.W. 71st
Street, and more specifically described as follows:
This is a subdivision of
all that part of the Northeast Quarter of Section 22, Township 51, Range 33,
being partially in Kansas City, Missouri, and partially in the City of
Gladstone, Clay County, Missouri, described as follows: Beginning at a point on
the east line of the Northeast Quarter of the said Section 22, said point being
North 030'19" East, a distance of 961.00 feet from the southeast corner
of the Northeast Quarter of said Section 22; thence South 8657'19" West,
a distance of 582.00 feet; thence North 030'19" East, along the east line
of Lots 25 through 36, both inclusive, Hamilton Heights West, a subdivision of
land in Kansas City and Gladstone, Clay County, Missouri, and the southerly
prolongation thereof, a distance of 767.02 feet to the northeast corner of Lot
36 of said Hamilton Heights West; thence South 8929'41" East, along the
south line of Lots 38 through 44, both inclusive, in the easterly prolongation
thereof, a distance of 580.88 feet to a point on the east line of the Northeast
Quarter of said Section 22; thence South 030'19" West, a distance of
730.98 feet to the point of beginning.
is hereby approved, subject to the following
conditions:
1. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer make any necessary improvements as required by
the City Engineers Office.
2. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
3. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
4. That
the developer extend water mains as required by the Water Services Department.
5. That
the developer provide for fire protection as required by the Fire Department.
6. That
the developer submit a final plan to the City Plan Commission for approval,
including plans for landscaping, grading, screening, berming and signage.
A copy of said amendment is on file in the
office of the City Clerk under Document No. 990189, which is attached hereto
and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed amendment hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
