COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 110818

Amending the Plaza Westport Neighborhood Plan for an approximately 2.6 acre tract of land generally located on the north side of W. 46th Street between Pennsylvania Avenue and Washington Street to change the recommended land use from medium density residential to high density residential and to recommend an increase in the maximum allowable building height. (611-S-2)

WHEREAS, on June 24, 2004, the City Council through the adoption of Resolution No. 040612 adopted the Plaza Westport Neighborhood Plan as a plan for future development within an area generally bounded 43rd Street/Westport Road on the north, Madison Avenue on the west, 46th Street/46th Terrace on the south and J.C. Nichols Parkway on the east; and

WHEREAS, due to certain changes, it is desirable to modify certain components of the Plaza Westport Neighborhood Plan by an amendment to the Land Use Plan and Map as it affects approximately 2.6 acres generally located on the north side of W. 46th Street between Pennsylvania Avenue and Washington Street from medium density residential to high density residential and to increase the maximum allowable building height; and

WHEREAS, public notice of a hearing before the City Plan Commission was published on August 22, 2011; and

WHEREAS, the City Plan Commission considered such amendment to the Land Use Plan and Map on September 6, 2011, and November 1, 2011; and

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on November 1, 2011, consider the proposed amendment to the Plaza Westport Neighborhood Plan and forward it to the City Council with no recommendation; ; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY, MISSOURI:

Section A. That the Plaza Westport Neighborhood Plan is hereby amended by changing the recommended land uses for an approximately 2.6 acre tract of land generally located on the north side of W. 46th Street between Pennsylvania Avenue and Washington Street from medium density residential to high density residential and to recommend an increase in the maximum allowable building height. A copy of the amendment to the Plaza Westport Neighborhood Plan is attached hereto as Exhibit A and is incorporated herein by reference.


Section B. That the amendment to the Plaza Westport Neighborhood Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices have been given and hearings have been had as required by law.
