COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 061355

Authorizing the Mayor to request the Municipal Judicial Nominating Commission to submit a panel of nominees for appointment as judges of Divisions 207 and 206 of the Kansas City Municipal Court; and declaring the City Councils decision to fill the current vacancy in Division 205 of the Kansas City Municipal Court.

WHEREAS, Division 207 of the Kansas City Municipal Court Division is currently vacant and has remained vacant since the retirement of former Municipal Court Judge Victor M. Rocha; and

WHERAS, it is anticipated that Division 206 of the Kansas City Municipal Court Division may soon become vacant if Municipal Court Judge James M. Reed retires in the near future; and

WHEREAS, a vacant Municipal Court judgeship also now exists in Division 205 of the Kansas City Municipal Court Division; and

WHEREAS, the Municipal Judicial Nominating Commission has provided the Council a panel of three nominees for appointment as the judge to fill this vacancy; and

WHEREAS, Section 310 of the Charter expressly provides that the Council does not have to appoint a person from such a panel if the Council chooses to not fill a vacancy; NOW, THEREFORE;

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Mayor is hereby requested and authorized to send a written request to the Municipal Judicial Nominating Commission to submit a panel of nominees for appointment as a judge to fill the vacancy in Division 207 and a panel to fill a vacancy in Division 206, if and when such a vacancy occurs.

Section 2. That the council hereby declares its decision to fill, at this time, the current Municipal Court judge vacancy in Division 205 of the Kansas City, Municipal Court Division left vacant by the retirement of Municipal Court Judge Marcia K. Walsh.
