COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090931

Approving the preliminary plat of Stuart Hall Condominiums on a 1.0 acre tract of land generally located at the northeast corner of W. 22nd Street and Central Street (2121 Central). (SD 1421).

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the preliminary plat of Stuart Hall Condominiums on an approximately 1.0 acre tract of land generally located at the northeast corner of W. 22nd Street and Central Street (2121 Central), and more specifically described as follows:

Property Description:

Lots 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, and 19, BLOCK 23, Goodrich Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

The above description was taken from Tract I of a Missouri Warranty Deed recorded as Document No. 2004K0009570 and contains 43,894 square feet or 1.008 acres, more or less.

 

Metes and Bounds Description:

All of Lots 9 through 19, both inclusive, Block 23, Goodrich Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, being more particularly described as follows: Beginning at the Northeast Corner of said Lot 9; thence South, along the East line of said Lots, a distance of 241.64 feet, to the Southeast Corner of said Lot 19; thence Southwesterly, along the South line of said Lot 19, a distance of 178.48 feet, to the Southwest Corner of said Lot 19; thence North, along the West line of said Lots, a distance of 534.40 feet, to the Northwest Corner of Lot 9; thence East, along the North line of said Lot 9, a distance of 152.30 feet, to the point of beginning. Containing 43,894 square feet or 1.008 acres, more or less.

is hereby approved, subject to the following conditions:

1. That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a letter from a Licensed Civil Engineer, Licensed Architect, or Licensed Landscape Architect, who is registered in the State of Missouri, stating the condition of the sidewalks, curbs, and gutters. The letter must identify state of repair as defined in Chapters 56 and 64 of the Code of Ordinances for the sidewalks, curbs, and gutters. It shall identify the quantity and location of sidewalks, curbs, gutters that need to be constructed, repaired, or reconstructed. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages, as required by Development Services, prior to recording the plat.

 

3. That the developer submit covenants, conditions and restrictions to Development Services for review by the Law Department for approval for the maintenance of common elements, prior to recording the plat.

 

4. That all wall dimensions, as well as all floor and ceiling elevations, for each of the condominium units be shown on the final plat.

 

5. That the developer contribute $12,755.75 in lieu of parkland dedication for 115 multifamily units (115 units X 2.0 X .006 X $9,243.30 (year 2009) = $12,755.75) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

6. That the developer provide for fire protection as required by the Fire Department.

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

Section 2. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
