ORDINANCE NO. 010731

 

Approving and authorizing settlement of the lawsuit styled Ahmed Albayer and Heather Albayer, individually and as next friend of Samantha Albayer, a minor v. City of Kansas City, Missouri, Case No. 99-CV-208271.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the settlement of the personal injury claim of Samantha Albayer and expenses and loss of services claim by Ahmed and Heather Albayer against the City of Kansas City, Missouri, resulting injuries sustained on or about April 25, 1998, as more fully set forth in, and the subject of, the lawsuit styled Ahmed Albayer and Heather Albayer, individually and as next friend of Samantha Albayer, a minor v. City of Kansas City, Missouri, Case No. 99-CV-208271, by payment to Ahmed Albayer, Heather Albayer and Samantha Albayer of the sum of $40,000.00, as recommended by the City Attorney and the Risk Management Committee, is hereby approved.

 

Section 2. That the City Attorney is hereby authorized to pay the sum of $40,000.00 in settlement of the claims from funds heretofore appropriated in Account No. 02-701-013-1521-B, General Liability Claims.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
