ORDINANCE NO. 970291

 

Approving a Community Unit Project on approximately a 0.76 acre tract of land generally located at the southwest corner of N.E. 88th Street and N. Oak Trafficway. (11894-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on approximately a 0.76 acre tract of land generally located at the southwest corner of N.E. 88th Street and N. Oak Trafficway, and more specifically described as follows:

 

The East 1/2 of Lot 1, Gashland Resurvey, a subdivision in the City of Kansas City, Clay County, Missouri, except a tract of land in Lot 1, Gashland Heights Resurvey, a subdivision in the Northwest Quarter of Section 11, Township 51 North, Range 33 West, in Kansas City, Clay County, Missouri, more particularly described as follows: Beginning at the southeast corner of Lot 1, being a point on the west right of way line of N. Oak Trafficway; thence South 89 54'01" West along the south line of Lot 1, a distance of 20.00 feet; thence North 00 40'34" East, being 50.00 feet west of and parallel with the east line of the Northwest Quarter of Section 11, a distance of 169.66 feet to a point of curvature of a curve to the left, having a central angle of 90 46'33" and a radius of 25.00 feet; thence northwesterly along the arc of that curve, a distance of 39.61 feet; thence South 89 54'01" West, being 5.00 feet south of and parallel with the north line of Lot 1, a distance of 144.67 feet to the west line of the property recorded in Book 2250, page 890; thence North 00 40'34" East along that line, a distance of 5.00 feet to the south right of way line of N.E. 88th Street; thence North 89 54'01" East along that south right of way line, a distance of 190.00 feet to the west right of way line of N. Oak Trafficway; thence South 00 40'34" West along that west right of way line a distance of 200.00 feet to the point of beginning. Said tract of land contains 0.76 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any improvements as required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer contribute $643.79 for 5 units in lieu of parkland dedication in satisfaction of Section 66-128 of the Subdivision Regulations.

 

5. That the developer extend water mains as required by the Water Services Department.

 

6. That the developer construct hard surface all-weather roads and provide for fire protection as required by the Fire Department prior to construction beyond

foundations.

 

7. That the developer dedicate additional right of way for N.E. 88th Street as required by the Department of Public Works so as to provide 40 feet of right of way as

measured from the section line of N.E. 88th Street.

 

8. That the developer improve one-half of N.E. 88th Street to residential street standards as required by the Department of Public Works including sidewalks, streetlights, curbs

and gutters.

 

9. That the developer receive the approval of the Department of City Development for a lot split prior to the sale of individual units.

 

10. That the developer secure the approval of the Board of Zoning Adjustment for the proposed monument sign.

 

11. That the developer submit covenants, conditions and restrictions to the Law Department for approval.

 

12. That the developer submit a street tree planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on right of way in

front of residential lots.

 

13. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 970291, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
