COMMITTEE SUBSTITUTE
FOR ORDINANCE NO. 070860
Amending Chapter 18, Code of
Ordinances, by repealing subsection 3201.6 of Section 18-40 and enacting in
lieu thereof a new subsection which imposes encroachment license fees; and
amending Chapter 64, Code of Ordinances, by repealing subsections (c) and (g)
of Section 64-161, Prohibited acts, exceptions, and fees, of Article V,
Obstructions and Encroachments and enacting in lieu thereof a new subsection
(c) of like subject matter which refers to Section 18-40, Code of Ordinances,
for encroachment license fees.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That
Chapter 18, Code of Ordinances, is hereby amended by repealing subsection
3201.6 of Section 18-40 and enacting in lieu thereof a new subsection to read
as follows:
Section 3201.6 License
fees. Encroachment into the right-of-way will be subject to the imposition
of an annual license fee of fifty dollars plus $.50 per square foot of
encroachment. Aerial (over seven feet above grade) or underground encroachments
shall be charged fifty dollars plus $.25 per square foot. Encroachments
granted to the State of Missouri and the United States will not require payment
of an encroachment fee because it is in the public interest to permit such
encroachments without additional costs to these public entities.
Section 2. That
Chapter 64, Code of Ordinances of the City of Kansas City, Missouri, is hereby
amended by repealing subsections (c) and (g) of Section 64-161, Prohibited
acts, exceptions, and fees, and enacting in lieu thereof a new section (c) of
like subject matter, to read as follows:
Sec. 64-161. Prohibited acts,
exceptions, and fees.
(c) Encroachment into the right-of-way, allowed by ordinance,
will be subject to the imposition of a license fee as set out in Section 18-40,
Code of Ordinances.
