ORDINANCE NO. 020914

 

Declaring the area of approximately 82 acres generally bounded by 28th Street on the north, Tracy Avenue on the east, 39th Street on the south and Campbell Street on the west, a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Planned Industrial Expansion law; approving an industrial development plan for the same area, said plan to be known as the Troost Corridor General Development Plan; and approving the availability of ad valorem tax benefits for the area. WHEREAS, Section 100.400, RSMo 1994, as amended, provides that a legislative body may approve a declaration of blight and approve an industrial development plan for the same area simultaneously; and

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri, submitted an industrial development plan for an area generally bounded by 28th Street on the north, Tracy Avenue on the east, 39th Street on the south and Campbell Street on the west, and recommended that the area is a blighted and insanitary area and in need of rehabilitation; and

 

WHEREAS, said area is blighted due to insanitary or unsafe conditions, deterioration of site improvements, and a combination of such factors as to constitute an economic or social liability to the public health, safety, morals and welfare; and

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri, did on May 29, 2002, adopt Resolution No. 682, approving the Troost Corridor General Development Plan Qualification Analysis, a Factual Evidence of Blight, and Resolution No. 683, approving the Troost Corridor General Development Plan; and

 

WHEREAS, the City Plan Commission reviewed and recommended approval of the designation of blight and approval of the industrial development plan on July 16, 2002, as evidenced by its resolution recommending approval of the adoption of said plan and found said plan to be in conformance with the Master Plans as amended for the development of the community as a whole, subject to certain conditions, a copy of which resolution is attached hereto and incorporated herein by reference as Exhibit "A"; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the proposed Planned Industrial Expansion Area identified as the Troost Corridor General Development Plan of approximately 82 acres generally bounded by 28th Street on the north, Tracy Avenue on the east, 39th Street on the south and Campbell Street on the west, and more specifically described as follows:

 

Commencing at the intersection of the north right of way line of 28th Street and the west right of way line of Forest Avenue said point also being the point of beginning of the herein described tract; thence east along said north right of way line of 28th Street to the east right of way line of Tracy Avenue; thence south along said east right


of way line of Tracy Avenue to the south right of way line of 31st Street; thence west along said south right of way line of 31st Street to the east right of way line of Forest Avenue; thence south along said east right of way line of Forest Avenue and a southerly prolongation thereof to the south right of way line of Linwood Boulevard; thence west along said south right of way line of Linwood Boulevard to the east right of way line of Forest Avenue; thence south along said east right of way line of Forest Avenue to the north right of way line of 33rd Street; thence east along said north right of way line of 33rd Street to the east right of way line of Tracy Avenue; thence south along the east right of way line of Tracy Avenue to the south right of way line of Armour Boulevard; thence west along said south right of way line of Armour Boulevard and continuing along an arc comprising the northwest corner of Lot 4, Block 2, Sedgewick Place, being a subdivision in Kansas City, Jackson County, Missouri, to a point on the east right of way line of Forest Avenue; thence south along said east right of way line of Forest Avenue to the southwest corner of Lot 4, Block 2, Sedgewick Place; thence westerly to the southeast corner of Lot 4, Block 2, Sedgewick Place; thence west along the south line of Lots 1 and 2, Block 1, Sedgewick Place to the southwest corner of said Lot 2; thence south along the west lines of Lots 20, 19, 18, 17, 16, 15, 14 and 13, Block 1, Sedgewick Place, to a point on the north right of way line of 36th Street; thence southerly to the northwest corner of Lot 24, Troost Park, being a subdivision in Kansas City, Jackson County, Missouri, said point being on the south right of way line of 36th Street; thence south along the west line of Lots 24, 23, 22, 21, 20, 19, 18, 17, 16, 15, 14 and 13, Troost Park, to a point on the north right of way line of 37th Street; thence east along said north right of way line of 37th Street to the east right of way line of Forest Avenue; thence south along said east right of way line of Forest Avenue to the southwest corner of Lot 13, Block 2, Squire Manor, being a subdivision in Kansas City, Jackson County, Missouri; thence southwesterly to the northeast corner of Lot 21, Block 3, Squire Manor, said point being on the south right of way line of Manheim Road; thence northwesterly along said south right of way line of Manheim Road to the northwest corner of Lot 21, Block 3, Squire Manor; thence southwesterly to the southeast corner of Lot 1, Block 3, Squire Manor; thence southeasterly along the east line of Lots 2 through 4, said Block 3, to the northeast corner of Lot 5, Block 3, Squire Manor; thence south along the east line of Lots 5 through 11, said Block 3, and along a southerly prolongation thereof to a point on the south right of way line of 39th Street; thence west along the south right of way line of 39th Street to a point being the intersection with the southerly prolongation of the east line of Lots 7 through 12, Woods, Waller & Holtz First Addition, being a subdivision in Kansas City, Jackson County, Missouri; thence north along said prolongation and east line of said Lots 7 through 12, to the northeast corner of said Lot 12; thence west to the southeast corner of Lot 8, Regents Park, being a subdivision in Kansas City, Jackson County, Missouri; thence north along the east line of Lots 8 and 9, Regents Park, to the northeast corner of said Lot 9; thence west along the north line of Lot 9, Regents Park, and a westerly prolongation thereof to the west right of way line of Harrison Boulevard as it now exists; thence north along said west right of way line of Harrison Boulevard and a northerly prolongation thereof to the north right of way line of Manheim Road; thence east along the north right of way line of Manheim Road to the southeast corner of Lot 14, Regents Park; thence north along the east line of said Lot 14, Regents Park, and the east lines of Lots 8 through 14, Harrison Boulevard Place, being a subdivision in Kansas City, Jackson County, Missouri, to the northeast corner of Lot 14, Harrison Boulevard Place, said point also being on the south right of way line of 37th Street; thence northwesterly to the intersection of the southerly prolongation of the east line of Lot 36, the Corrected Plat of Troost Avenue Heights, being a subdivision in Kansas City, Jackson County, Missouri, and the north right of way line of 37th Street, as it now exists; thence north along said southerly prolongation and east line of said Lot 36 to the northeast corner of said Lot 36; thence east 6 feet along the south line of Lot 38, the Corrected Plat of Troost Avenue Heights; thence north and parallel to the west line of said Lot 38 to the north line of said Lot 38; thence west to the northwest corner of said Lot 38; thence north along the west lines of Lots 39 through 43 to the southwest corner of Lot 44, the Corrected Plat of Troost Avenue Heights; thence east 15 feet along the south line said Lot 44; thence north along a line parallel to the west lines of Lots 44 through 47 to the north line of Lot 47, the Corrected Plat of Troost Avenue Heights; thence west along the north line of said Lot 47 to the northwest corner of said Lot 47; thence north along the west line of Lot 48, the Corrected Plat of Troost Avenue Heights to the northwest corner of said Lot 48; thence north along the east lines of Lots 9 through 13 and the south 15 feet of Lot 14, Arcade Annex, being a subdivision in Kansas City, Jackson County, Missouri, to a point on the south right of way line of 36th Street, as it now exists; thence northeasterly to a point on the north right of way line of 36th Street, as it now exists, said point being 7.5 feet east of the southeast corner of the north 15 feet of Lot 15, Arcade Annex; thence north and parallel to the east line of the north 15 feet of said Lot 15 and the east line of Lot 16, Arcade Annex, to the north line of Arcade Annex; thence north to a point on the south line of Nicolett Place, being a subdivision in Kansas City, Jackson County, Missouri, said point being 7.5 feet east of the southeast corner of Lot 12, said Nicolett Place; thence easterly along a prolongation of the north line of said Lot 21 to a point 7.5 feet east of the northeast corner of said Lot 21; thence north along a line 7.5 feet east of and parallel to the east line of Lots 20, 19, 18, 17, 16 and 15, Block 2, Troost Avenue Park, and a northerly prolongation thereof to a point on the south line of Lot 9, Chadwicks Subdivision, being a subdivision in Kansas City, Jackson County, Missouri; thence west along the south line of Lots 9, 10 and 11, Chadwicks Subdivision, and Lot A, Resurvey of Lots 5 through 8 & 12 through 15, Chadwicks Subdivision, being a subdivision in Kansas City, Jackson County, Missouri; to the east right of way line of Campbell Street; thence north 130 feet on said east right of way line of Campbell Street; thence east along a line 130 feet north of and parallel to the south lines of said Lot A and said Lot 11 to a point on the east line of said Lot 11; thence north along the east line of said Lot 11, Chadwicks Subdivision, and a northerly prolongation thereof to the north right of way line of 31st Street; thence east along said north right of way line of 31st Street to the west right of way line of Harrison Street; thence north along said west right of way line of Harrison Street to the north right of way line of 30th Street; thence east along said north right of way line of 30th Street to the west right of way line of Troost Avenue; thence north along said west right of way line of Troost Avenue to the westerly prolongation of a line 22 feet north of the south line of Lot 3, Block 13, Beacon Hill Annex, being a subdivision in Kansas City, Jackson County, Missouri; thence east along said prolongation and parallel to the north line of said Lot 3, Block 13, Beacon Hill Annex, to the west right of way line of Forest Avenue; thence north along said west right of way line of Forest Avenue to the point of beginning.

 

is a blighted area and in need of redevelopment and rehabilitation and is appropriate for a Planned Industrial Expansion Area project, and that the undertaking by the Planned Industrial Expansion Authority of Kansas City, Missouri, of surveys and plans for a Planned Industrial Expansion Area project of the character contemplated by Section 100.300, et seq., Revised Statutes of Missouri, 1994, as amended, ("RSMo"), and the proposed Planned Industrial Expansion Area is hereby approved.

 

Section 2. That the Industrial Development Plan for the Troost Corridor Area as described above and which is known as the Troost Corridor General Development Plan, is hereby approved. A copy of the Troost Corridor General Development Plan is incorporated herein by reference and is on file in the office of the City Clerk under Document No. 020914.

 

Section 3. That the Council has duly made the findings necessary for compliance with Section 100.400, RSMo.

 

Section 4. That said Industrial Development Plan is hereby found to be feasible and in conformance with the General Plan for the development of the community as a whole.

 

Section 5. That the Council hereby approves of the availability of ad valorem tax benefits for the Troost Corridor General Development Plan Area pursuant to Section 100.570, RSMo.

 

Section 6. That the Council finds and declares that before taking any action on the proposed declaration of blight, the Industrial Development Plan and ad valorem tax benefits, all public notices have been given and hearings have been held as required by law.
