ORDINANCE NO. 110113

 

Approving the plat of Park Plaza Commercial Second Plat, an addition in Platte County, Missouri; accepting and releasing various easements; and authorizing the City Clerk to record this ordinance and attached documents. (SD0583C)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Park Plaza Commercial Second Plat, a subdivision in Platte County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference, is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That a certain easement in Kansas City, Platte County, executed by the following entity, and which appears of record as the instrument number below, is hereby accepted for the purposes stated thereof:

That all right, title and interest in a standard sanitary sewer easement accepted by Kansas City, under Book 434, Page 359, be and the same is hereby released to the respective owner, their successors or assigns, over that part of aforesaid easement described as follows:

A strip of land 10 feet wide through part of the Southeast Quarter of Section 19, Township 51, Range 33 in Kansas City, Platte County, Missouri, lying 5 feet on each side of the following described centerline: Beginning at a point lying 290.88 feet normally North of the South line and 308.01 feet normally West of the East line of said quarter section; thence North 44 degrees 53 minutes 18 seconds West, (calculated North 44 degrees 05 minutes 31 seconds West) this and subsequent bearings referring to the East line of the Southeast quarter of said Section 19 as having a bearing of North 0 degrees 44 minutes 12 seconds East, a distance of 162.20; thence North 89 degrees 46 minutes 33 seconds West (calculated North 88 degrees 58 minutes 46 seconds West), a distance of 295.43 feet to a point on the Easterly right of way line of N Chatham Avenue as deeded in Book 1143 at Page 690 and the Point of Termination of said Easement Release; the outer limits of said release are to lengthened or shortened as necessary to terminate on said Easterly right of way line at the Point of Termination.

Section 5. That the City Clerk is hereby directed to record copies of this ordinance, together with the documents described herein and all other relevant documents, when the plat has been released for recording, in the Office of the Recorder of Deeds of Platte County, Missouri.

 

Section 6. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
