ORDINANCE NO. 160398

 

Amending the 2016 One Year Action Plan and authorizing submittal of a Substantial Amendment to the U.S. Department of Housing and Urban Development for its consideration; authorizing the execution of a $511,000.00 contract, financing agreement and loan documents with MorningStar Senior, LP from funds in the HOME Investment Partnerships Program Fund, to provide partial funding to support construction of 40 units of affordable senior housing at 2711 Wabash.

WHEREAS, on March 7, 2016, through Resolution No. 160042, the Council approved the 2016 One-Year Action Plan which included Home Investments Partnerships Program (HOME) funds for rental housing development; and

WHEREAS, on April 8, 2016, in response to a second request for proposals for projects in specific target areas, the City received proposals which included the MorningStar Senior Housing Project at 28th Street and Prospect Avenue; and

WHEREAS, Council is required to approve and authorize submission of substantial amendments to the 2016 One-Year Action Plan to the U.S. Department of Housing and Urban Development; and

WHEREAS, MorningStar Senior Apartments was awarded 2016 State and Federal 9% low income housing tax credits through the Missouri Housing Development Commission and City HOME funds are necessary in order for the project to move forward; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Substantial Amendment to the 2016 One Year Action Plan prepared pursuant to the National Affordable Housing Act of 1990, as amended, a copy of which in substantial form is attached hereto, is hereby approved.

Section 2. That the Mayor, on behalf of the City of Kansas City, Missouri, is authorized to execute and submit the aforesaid Substantial Amendment to HUD.

Section 3. That the Director of Neighborhoods and Housing Services is hereby authorized to execute a $511,000.00 contract, financing agreement and loan documents with MorningStar Senior, LP, for hard construction costs in support of MorningStar Senior Apartments. The project will create forty (40) units of affordable two bedroom senior apartment units from funds appropriated to Account No. 17-2940-575326-G57HOME16. A copy of the contract, in substantial form, is on file in the office of the Director of Neighborhoods and Housing Services and is incorporated herein by reference.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
