Approving the preliminary plat of
Crown Center Second Plat on a 5.6 acre tract of land generally located on
either side of 25th Street (extended) between Main Street and Grand Boulevard. (SD 0505A)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Crown Center Second Plat on a 5.6 acre tract of land
generally located on either side of 25th Street (extended) between Main Street and Grand Boulevard, and more specifically described as follows:
Part of the
Southwest 1/4 of Section 8, Township 49, Range 33 in Kansas City, Jackson
County, Missouri, including all or part of the following platted lots: Lots 6
thru 17 and Lots 31 thru 50, inclusive, Vineyards 4th Addition, Lots
A thru E, inclusive, Commissioners Plat of Lot 24, Scarritt & Peerys
Subdivision; Lots 22 and 23, Scarritt & Peerys Subdivision; Lots 4 thru 9,
inclusive Christ Kohlmeyer's Addition, being more particularly described as
follows: Commencing at a point on the east line of Lot 3, Amended Plat of James
Dowlings Addition, a subdivision in Kansas City, Jackson County, Missouri and
7.68 feet north of the southeast corner thereof, said point also being the
intersection of the south line of Pershing Road and the west line of Grand
Boulevard, as said streets are now established; thence South 2-24-32 West, along the west right
of way line of said Grand Boulevard, a distance of 510.22 feet; thence South 24-33-36 West, continuing along said
west right of way line, a distance of 303.86 feet to the true point of
beginning of the tract of land to be herein described; thence continuing South
24-33-36 West along the
westerly line of said Grand Boulevard, a distance of 340.35 feet to a jog in
the west right of way line of said Grand Boulevard; thence South 87-17-37 East along said jog, a
distance of 9.23 feet: thence South 23-13-27
West continuing along said westerly line of Grand Boulevard a distance of
205.73 feet: thence southwesterly continuing along said west right of way
line, along a curve to the left, tangent to the last described course, having a
radius of 490.00 feet, an arc distance of 53.47 feet to the northeast corner of
Lot 1, Crown Center Subdivision. a subdivision; thence North 87-34-32 West along the north line of
Lot 1, a distance of 253.13 feet to the northwest corner thereof, said point
also being on the east line of Main Street, as now established; thence North 2-48-21 East along the east line of
said Main Street a distance of 453.38 feet; thence North 1-39-56 West, continuing along the
east line of said Main Street a distance of 282.19 feet: thence North 2-23-24 East, continuing along
the east line of said Main Street a distance of 33.48 feet; thence South 87-34-32 East, a distance of 260.74
feet; thence South 2-25-28
West a distance of 209.77 feet; thence South 87-34-32
East, a distance of 217.81 feet to the true point of beginning, except any part
thereof in the San Francisco Condominium Subdivision, a subdivision.
Containing 5.52 acres more or less.
is hereby approved, subject to
the following conditions:
1. That the developer abide by any further recommendations
and/or corrections of the City Engineers Office.
2. That the developer shall cause the area to be platted and
processed in accordance with Chapter 66, Code of Ordinances of the City of
Kansas City, Missouri, commonly known as the Subdivision Regulations.
3. That the developer secure permits to repair sidewalks, curbs,
and gutters as necessary along all development street frontages as required by
the Department of Public Works in accordance with Chapters 56 and 64 of the
Code, prior to recording of the plat.
4. That the developer provide a cross access easement on the
final plat as required by the Department of Public Works.
5. That the developer dedicate additional right of way for
primary arterial as required by the Department of Public Works so as to provide
a total of 50 feet of right of way as measured from the centerline of Main
Street, except that from approximately the north line of Lot 4, Christ
Kohlmeyers Addition to the southern property line, the developer will dedicate
a no-build easement rather than right of way. (The no-build easement is
intended to be in the area from 20 feet north of the driveway to the Santa Fe Place building to the south property line.)
6. That the developer provide for fire protection as required by
the Fire Department.
7. That the developer obtain approval for any necessary
variances from the Board of Zoning Adjustment.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance, which is attached
hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
Section C. That
the findings of fact and conclusions of law entered by the City Plan Commission
regarding this preliminary plat are hereby approved and adopted, except insofar
as they conflict with Section D, below.
Section D. That
the requirements of the subdivision regulations that the plat comply with the
major street plan is hereby varied insofar as it requires the dedication of
right of way from the north line of Lot 4, Christ Kohlmeyers Addition, to the
south property line of this development, is hereby waived because the grade of
the property at the location creates potential safety issues, this variance is
necessary for the acceptable development of the property and the variance will
not be detrimental to the public welfare or injurious to other property in the
vicinity of this property.
I hereby certify
that as required by Chapter 66, Code of Ordinances, the foregoing ordinance was
duly advertised and public hearings were held.
