ORDINANCE NO. 160144

 

Rezoning a 0.3 area site at 1717 W. 9th Street, on the south side of West 9th Street, just east of State line, from District M 3-5 to District DX-7. (14620-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A1042, rezoning 0.3 acres generally located at 1717 W. 9th Street, on the south side of W. 9th Street, just east of State line from District M 3-5 (Manufacturing 3 (dash 5)) to District DX-7 (Downtown Mixed Use (Dash 7)), said section to read as follows:

 

Section 88-20A1042. That an area legally described as:

 

TRACT I: All of that part of Block 34, West Kansas Addition No. 1 described as follows: Beginning at a point on the South line of 9th Street, 80 feet East of the State line between Missouri and Kansas; thence Eastwardly along said South line of 9th Street, 50 feet; thence Southwardly at right angles to said Street, 125 feet; thence Westwardly at right angles to last described line, 50 feet; thence Northwardly at right angles to last described line, 125 feet to beginning, in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT II: Part of Block 34, West Kansas, a subdivision in Kansas City, Jackson County, Missouri described as follows: Beginning at the intersection of the South line of 9th Street with the East line of State Line Street, as said streets are now established; thence East along the South line of 9th Street 25 feet; thence South 125 feet; thence West 22 .1 feet to a point in the East line of State Line Street; thence North along said East line 125 feet to the point of beginning.

 

TRACT III: Beginning at a point in the South line of Nine Street in Kansas City, Missouri, 55 feet East of the boundary line between the States of Missouri and Kansas, and running thence Easterly 25 feet on said Street line; thence Southerly at right angles to said Street 125 feet; thence Westerly at right angles to last above described course and line 22.1 feet, more or less, to a point 52.1 feet East of said State boundary line; thence Northerly 125.13 feet, more or less, to a point of beginning; said tract being in the Westerly part of Block 34, in West Kansas Addition No. 1, Kansas City, Jackson County, Missouri.

 


Also described as follows:

 

A tract of land located in part of Block 34, West Kansas Addition No. 1 in the Northwest Quarter of Section 6, Township 49, Range 33, in Kansas City Jackson County, Missouri , being more particularly described as follows: Commencing at the Northwest corner of said Block 34; thence South 89 degrees 58 minutes 34 seconds East along the North line of said Block 34 also being the South right- of-way line of 9th Street a distance of 30.03 feet to the point of beginning of the tract of land to be described; thence South 89 degrees 58 minutes 34 seconds East along the North line of said Block 34 also being the South right-of-way line of 9th street a distance of 100 feet to a point that is 0.06 feet East of an existing Building; thence South 00 degrees 01 minutes 26 seconds West along a line that is 0.06 feet East of and parallel to said existing Building, a distance of 125 feet; thence North 89 degrees 58 minutes 34 seconds West a distance of 94.48 feet to a point on the East right-of-way line of State Line Road; thence North 02 feet 30 minutes 13 seconds West along the East right-of-way line of State Line Road a distance .of 125.12 feet to the point of beginning:

 

is hereby rezoned from District M 3-5 (Manufacturing 3 (dash 5)) to District DX-7 (Downtown Mixed Use (Dash 7)), all as shown outlined on a map marked Section 88-20A1042, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
