COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 980653

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0152, rezoning an area of approximately 23 acres generally located at the southeast corner of Interstate 35 and Chouteau Trafficway from Districts R-1b (One-Family Dwellings), CP-1 (Neighborhood Planned Business Center) and CP-2 (Local Planned Business Center) to District URD (Urban Redevelopment District), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0152, rezoning an area of approximately 23 acres generally located at the southeast corner of Interstate 35 and Chouteau Trafficway from Districts R-1b (One-Family Dwellings), CP-1 (Neighborhood Planned Business Center) and CP-2 (Local Planned Business Center) to District URD (Urban Redevelopment District), said section to read as follows:

 

Section 80-11A0152. That an area legally described as:

 

All that part of Blocks 4, 5 and 6, and Lake Winnetonka, in Winnwood Beach, a subdivision, and part of vacated Cleveland Avenue and part of vacated N.E. 43rd Street Terrace and part of vacated Winnwood Boulevard, all in the East 1/2 of Section 6, Township 50, Range 32, all in Kansas City, Clay County, Missouri, more particularly described as follows: Commencing at the northeast corner of said Block 4; thence North 8917'19" West, 10.00 feet along the north line of said Block 4; thence parallel with the east line of said Block 4, South 0038'34" West, 480.01 feet to the point of beginning; thence South 0038'34" West, 1030.07 feet parallel with said east line of said Block 4 to the centerline of vacated N.E. 43rd Street Terrace; thence with said centerline of said vacated 43rd Street Terrace, North 8917'22" West, 115.03 feet; thence North 7633'13" West, 91.46 feet; thence South 8942'23" West, 418.76 feet; thence along a curve to the right, having a radius of 130.00 feet, a central angle of 7745'17", and an arc length of 176.42 feet; to a point of compound curvature, having a radius of 490.00 feet, a central angle of 0019'34", and an arc length of 2.79 feet; thence leaving said centerline of vacated 43rd Street Terrace, South 7746'47" West, 10.00 feet to the southeast corner said Block 6; thence North 8917'49" West, 44.30 feet along the south line of said Block 6; thence North 4519'45" West, 262.48 feet to a point on the centerline of said vacated Cleveland Avenue; thence North 4604'00" West, 263.89 feet along the northerly right of way line of N.E. Chouteau Trafficway to the southeast right of way line of Interstate Highway No. 35; thence along said southeast right of way line of Interstate Highway No. 35 the following courses: North 4905'36" East, 625.72 feet; thence North 6704'30" East, 107.95 feet; thence North 4936'56" East, 211.99 feet; thence North 1813'01" East, 66.87 feet; thence North 4914'01" East, 200.00 feet; thence leaving said southeast right of way line of Interstate Highway No. 35, South 0038'34" West,


241.11 feet; thence South 8921'26" East, 289.76 feet to the point of beginning. Containing 933,312.5 square feet or 20.6 acres more or less and subject to rights of way, easements, covenants and restrictions of record or fact.

 

is hereby rezoned from Districts R-1b (One-Family Dwellings), CP-1 (Neighborhood Planned Business Center) and CP-2 (Local Planned Business Center) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 80-11A0152, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the first final plat is submitted and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer dedicate additional right of way for Chouteau Trafficway as required by the Department of Public Works so as to provide 80 feet of right of way as measured from the centerline of Chouteau Trafficway.

 

6. That the developer improve Chouteau Trafficway to parkway standards as required by the Department of Public Works, including construction of a southbound left turn lane and two through lanes.

 

7. That the developer realign N. Cleveland Avenue on the west side of Chouteau Trafficway so as to align N. Cleveland Avenue with the proposed driveway into the development on the east side of Chouteau Trafficway as required by the Department of Public Works and the Missouri Department of Transportation.

 

8. That the developer enter into a Deferral Agreement with the City for the improvement of the west half of N.E. Winn Road to residential street standards as required by the Department of Public Works, including construction of curb, gutter, and sidewalks and installation of streetlights.

 

9. That the developer secure the approval of the Missouri Highway and Transportation Department prior to working in any State right of way.

 

10. That the developer secure the approval of the Missouri Department of Transportation for access locations onto Chouteau Trafficway.

 

11. That the developer show limits of the floodplain on the final plat as required by the Department of Public Works.

 

12. That the developer obtain a floodplain certificate if any grading is to occur within a floodplain as required by the Department of Public Works.

 

13. That the developer extend water mains as required by the Water Services Department.

 

14. That the developer extend sanitary sewers as required by the Department of Public Works.

 

15. That the developer provide for fire protection as required by the Fire Department.

 

16. That the developer submit site plans for each project or phase to the Director of the Department of City Development for approval prior to the issuance of building permits. The site plans shall include: development plan information, property uses, setback distances, lighting, landscaping, signage, and architectural characteristics (including elevation drawings).

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 980653, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
