Approving an amendment to a previously approved Community
Unit Project on a 263.7 acre tract of land generally located at the southeast
corner of N.W. 76th Street and N. Baughman Road. (6445-CUP-2)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved Community Unit Project on a 263.7 acre tract of land generally located
at the southeast corner of N.W. 76th Street and N. Baughman Road, and more
specifically described as follows:
A tract of land lying in the Fractional Southwest
Quarter and the Southeast Quarter of Section 15, and the Northeast Quarter
of Section 22, all in Township 51, Range 33, Kansas City, Clay County,
Missouri, and the Fractional Southwest Quarter of Section 15 and the
Fractional Northwest Quarter of Section 22, all in Township 51, Range 33,
Kansas City, Platte County, Missouri, being bounded and described as
follows: Beginning at the northwest corner of the Fractional Southwest Quarter
of said Section 15, Platte County; thence North 89 21'06" East along
the north line of said Fractional Southwest Quarter, 775.00 feet to the
northwest corner of the Fractional Southwest Quarter of said Section 15,
Clay County; thence North 89 21'06" East, along the north line of
said Fractional Southwest Quarter, 1823.51 feet to the northwest corner of
the Southeast Quarter of said Section 15, Clay County; thence South 89 25'11"
East, along the north line of said Southeast Quarter, 1326.89 feet to a
point on the west line of U.S. Highway 169, as now established; thence

60.00 feet to a point on the south line of said N.W. Hidden Lakes Drive;
thence northwesterly along said south line, along a curve to the right,
having an initial tangent bearing of North 43 16'22" East, a radius of
517.25 feet, an arc distance of 123.50 feet; thence North 29 35'34"

123.99 feet; thence westerly along a curve to the right, tangent to the
last described course, having a radius of 230.00 feet, an arc distance of

14'52" East, 156.98 feet to a point on the south line of the
Fractional Southwest Quarter of said Section 15, Clay County; thence South
89 45'08" West, along said south line, 1773.54 feet to the southwest
corner of said Fractional Southwest Quarter, Clay County; thence South 0
11'10" East, along the east line of the Fractional Northwest Quarter
of said Section 22, Platte County, 1296.73 feet; thence South 89
21'06" West, 787.00 feet to a point on the west line of said
Fractional Northwest Quarter; thence North 0 34'47" East, along said west
line, 1302.37 feet to the northwest corner of said Fractional Northwest
Quarter; thence North 0 34'47" East, along the west line of the
Fractional Southwest Quarter of said Section 15, Platte County, 2630.76
feet to the point of beginning. Containing 263.73 acres, more or less.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study for the entire development to the City Engineer's Office for
approval when the first plat is submitted and that
improvements be made as required by the City
Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control for permitting prior to beginning any
construction activities.
4. That the developer secure the approval of the
Street Naming Committee for all street names and submit a street name
and signage plan to the Street Naming Committee.
5. That the developer install hard surface roads
and provide for fire protection prior to construction beyond
foundations.
6. That the developer construct temporary
cul-de-sacs as required by the Department of Public Works for each
phase.
7. That the developer extend water mains as
required by the Water Department.
8. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
9. That the developer dedicate additional right of
way as required for N.W. 76th Street so as to insure 30 feet of right
of way as measured from the centerline of N.W. 76th
Street.
10. That the developer dedicate 80 feet of right of
way for N. Baughman Road.
11. That the developer improve one-half of N.W. 76th
Street to collector street standards.
12. That the developer improve N. Baughman Road to
arterial street standards.
13. That the developer dedicate 60 feet of right of
way for Hidden Lakes Drive, east of N. Baughman Road.
14. That the developer construct Hidden Lakes
Drive, east of N. Baughman Road, to collector street standards.
15. That the developer dedicate 60 feet of right of
way for Reiger Road.
16. That the developer construct Reiger Road to
collector street standards.
17. That the developer dedicate 60 feet of right of
way for the north/south street serving the apartments on the east
side of the development and construct the north/south
street to collector street standards.
18. That the developer improve Hidden Lakes Drive,
west of N. Baughman Road, to arterial street standards and dedicate
80 feet of right of way for Hidden Lakes Drive,
west of N. Baughman Road.
19. That the developer receive the approval of the
Missouri Highway and Transportation Department prior to any work in
State right of way.
20. That the developer relocate the existing
overhead power line or include its location on the appropriate final
plats.
21. That the developer obtain a floodplain
certificate prior to any construction within the floodplain.
A copy of said Community Unit Project plan amendment is
on file in the office of the City Clerk under Document No. 951506, which is
attached hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
