SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 030368

 

Approving the preliminary plat of Fredericks Acres on a 20 acre tract of land located on the north side of N.E. 88th Street, approximately 600 feet west of N. Highland Avenue (1412 N.E. 88th Street). (SD 1039)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Fredericks Acres on a 20 acre tract of land located on the north side of N.E. 88th Street, approximately 600 feet west of N. Highland Avenue (1412 N.E. 88th Street), and more specifically described as follows:

 

All of the west half of the Southeast Quarter of the Southwest Quarter of Section 1, Township 51, Range 33 in Kansas City, Clay County, Missouri, except for that part taken for road purposes.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the 3:1 lot depth to width ratio for the two proposed lots as shown on the preliminary plat be waived.

 

3. That the developer dedicate additional right of way for N.E. 88th Street as required by the Department of Public Works so as to insure 25 feet of right of way as measured from the centerline of N.E. 88th Street.

 

4. That the developer secure a grading permit from the Department of Codes Administration prior to beginning any construction activities.

 

5. That the developer obtain a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities within the floodplain.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 030368, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
