ORDINANCE NO. 931399

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2495, rezoning an area of approximately 2.0 acres generally located between Main Street and Walnut Street at 42nd Street from Districts C-2 (Local Retail Business) and R-4 (Low Apartments) to District URD (Urban Redevelopment District), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2495, rezoning an area of approximately 2.0 acres generally located between Main Street and Walnut Street at 42nd Street from Districts C-2 (Local Retail Business) and R-4 (Low Apartments) to District URD (Urban Redevelopment District), said section to read as follows:

 

Section 65.010A2495. That an area legally described as:

 

TRACT I: Lot 6, except that part taken for Main Street, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT II: Lots 7 and 8, except that part in Main Street, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT III: The north 25 feet of Lot 9, except that part in Main Street, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT IV: The South 1/2 of Lot 9, except that part in Main Street, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT V: Lot 10, except that part in Main Street, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT VI: Lots 11 and 12, except that part of said lots in Main Street, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT XIV: Lot 22, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT XV: Lot 21, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT XVI: Lot 20, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT XVII: Lot 19, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT XVIII: Lot 18, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT XIX: Lot 17, D.S. LONGS SUBDIVISION OF LOTS 50 to 59 INCLUSIVE OF GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri.

 

is hereby rezoned from Districts C-2 (Local Retail Business) and R-4 (Low Apartments) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 65.010A2495, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer for approval, including provision for any

needed improvements.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for

approval prior to the commencement of any construction.

 

4. That the developer provide for fire protection as required so that all portions of the building are within

150 feet of a fire hydrant.

 

5. That the developer submit a site plan for approval by the Director of the Department of City Development, which

includes detailed information on signage, landscaping,

lighting and architectural features.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 931399, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
