ORDINANCE NO. 990662

 

Calling for submission to the voters of Kansas City, at a special election to be held on August 3, 1999, a question amending Section 50 of the Charter of Kansas City entitled Department established, organized to increase the number of commissioners on the Board of Parks and Recreation Commissioners from three to five; directing the City Clerk to notify the responsible election authorities of the election; and recognizing this ordinance to be an emergency measure.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. Election called. That an election is called for the purpose of submitting to the voters of Kansas City at a special election to be held August 3, 1999, an amendment to the Charter of Kansas City to increase the size of the Board of Parks and Recreation Commissioners from three to five commissioners.

 

Section 2. Delivery of ordinance by City Clerk. That upon passage of this ordinance the City Clerk shall immediately deliver certified copies of this ordinance and notice of election to the Board of Election Commissioners of Kansas City, Missouri, to the Board of Election Commissioners of Clay County, Missouri, to the Board of Election Commissioners of Platte County, Missouri, and to the Clerk of the County Commission of Cass County, Missouri, which shall be the authority of the respective election authorities of the City to submit the amendment to the electors of Kansas City as herein provided and to give public notice thereof as provided by law.

 

Section 3. Election notice. The notice of election shall read as follows:

KANSAS CITY, MISSOURI

 

Notice is hereby given that Kansas City has called a special election to be held in the City on Tuesday, August 3, 1999, between the hours of 6:00 a.m. and 7:00 p.m., at which election all qualified voters residing within Kansas City, Missouri will be given the opportunity to vote.

 

The official ballot will be in substantially the following form:

Section 4. Amendment to the Charter. If a majority of the qualified voters voting shall vote in favor of the question, then an amendment to the Charter of Kansas City, Missouri shall become effective immediately upon certification of the election results by the election authorities, which amendment shall read as follows:

 

BE IT ADOPTED BY THE PEOPLE OF KANSAS CITY:

 

That the Charter of Kansas City, Missouri, adopted February 25, 1925, as amended, is further amended by repealing Section 50, entitled Department established, organized and enacting a new Section 50, Department established, organized to read as follows:

 

Sec. 50. Department established, organized.

 

The park department established under this charter is and shall be deemed a continuation of the department of parks and boulevards as it existed under the charter which is hereby superseded and of the department of parks existing under previous charters, and shall be known as the parks and recreation department. The board of park commissioners shall be known as the board of parks and recreation commissioners and the superintendent of parks shall be known as the director of parks and recreation. From and after the effective date hereof, any reference in this charter or in the ordinances to the park department, board of park commissioners, or superintendent of parks, shall be construed to refer to and mean the parks and recreation department, the board of parks and recreation commissioners, and director of parks and recreation, respectively.

 

The parks and recreation department shall be under the control and management of a board of parks and recreation commissioners. Such board shall consist of five members appointed by the mayor to serve during the term for which the mayor shall have been elected and until their successors are appointed and have qualified. One of the members shall be designated by the mayor as president of the board. The members may be removed by the council upon recommendation of the mayor.

 

Section 5. Emergency recognized. This ordinance, providing for the submission of a Charter amendment to the people of Kansas City, Missouri, is hereby recognized to be an emergency measure within the meaning of Section 15, Article II, of the Charter of Kansas City, and as such shall become effective immediately upon its passage.
