ORDINANCE NO. 940579

 

Approving an amendment to a previously approved development plan in District GPR-1 (Residential, Low Density) on a 10 acre tract of land generally located approximately 1,320 feet east of Raytown Road and approximately 250 feet south of Sherer Parkway. (9638-GP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GPR-1 (Residential, Low Density) on a 10 acre tract of land generally located approximately 1,320 feet east of Raytown Road and approximately 250 feet south of Sherer Parkway, and more specifically described as follows:

 

All that part of the Northeast Quarter of Section 20 and the West Half of Section 21, in Township 47, Range 32, in Kansas City, Jackson County, Missouri, more particularly described as follows: Commencing at the intersection of the north line of said Section 21 and the corporate limit line between Kansas City and Lee's Summit, in said county and state as said corporate limit line is now established 180 feet east of the west line of said Section 21; thence south along said corporate limit line, 682.59 feet to the point of beginning of the tract of land to be herein described; thence continuing south along said corporate limit line, 2289.29 feet to a point in the line drawn 331.09 feet south of and parallel with the south line of the Northwest Quarter of said Section 21; thence west along said parallel line, 180 feet to the west line of said Section 21, being also the east line of said Section 20; thence north along said east line, 991.24 feet to the southeast corner of the North Half of the Southeast Quarter of the Northeast Quarter of said Section 20; thence northerly along a straight line, 329.68 feet to a point which is 14 feet west of the east line of said Section 20, measured parallel with the south line of the Northeast Quarter of the Northeast Quarter of said Section 20; thence north, parallel with the east line of said Section 20, 330.88 feet to a point on the south line of said Northeast Quarter of the Northeast Quarter of Section 20; thence north, parallel with the east line of said Section 20; 724.18 feet; thence southeasterly along a curve to the right, having a radius of 750 feet, a central angle of 1618'32" and an initial tangent which deflects 10605'30" right from the last described course, a distance of 213.48 feet to the point of beginning; excepting therefrom that part, if any now in public way. Containing 10.01 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer pay money in lieu of parkland dedication in the amount of $3,853.12 for 21 single

family dwellings pursuant to Section 31.32, Code of

General Ordinances of Kansas City, Missouri.

 

3. That the developer extend water mains as required by the Water Department and that the lots in Kansas City be

served by the Kansas City, Missouri Water Department.

 

4. That the developer submit a storm drainage study to the City Engineer's Office for approval, including provision

for any needed improvements.

 

5. That the developer extend off-site sanitary sewers to serve each lot with a separate sewer service connection.

 

6. That the developer submit a full disclosure statement with this phase of development.

 

7. That the developer grant a noise and aviation easement to the City.

 

8. That the developer state on all plans and plats that the proposed development is located within the area of the

Richards-Gebaur Air Force Base Height Restrictions and

provide that no structure be built which exceeds these

restrictions.

 

9. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for

approval prior to beginning any construction.

 

10. That the developer obtain a land disturbance permit from the Missouri Department of Natural Resources.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 940579, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
