COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 170455

 

Authorizing the Director of Neighborhoods and Housing Services Department to execute a $415,549.00 amendment to a cooperative agreement with Linwood Shopping Center Initiative, LLC (LSCI) for construction and rehabilitation services related to the Linwood Shopping Center; and recognizing this ordinance as having an accelerated effective date.

 

WHEREAS, City entered into an agreement with LSCI on April 28, 2017, for design and construction of retail space within the Linwood Shopping Center; and

 

WHEREAS, City and LSCI wish to amend the agreement to incorporate additional items of work required for the completion of renovation; and

 

WHEREAS, an amendment to the agreement requires authorization by the City Council; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Neighborhoods and Housing Services Department is hereby authorized to execute a $415,549.00 Amendment No. 1 to a Cooperative Agreement with LSCI for construction services associated with the rehabilitation of the retail spaces located at 3106 Prospect and 3130 Prospect in the Linwood Shopping Center for a total contract amount of $1,714,828.00 from funds previously appropriate to account No. 3436-577300-57020342.

 

Section 2. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3) of the City Charter and shall take effect in accordance with Section 503 of the City Charter.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
