Rezoning an area of approximately
13 acres generally located on the west side of M-291 (N.E. Cookingham Drive)
between N.E. 104th Street on the south and N.E. 105th Street on the north from
District CP-2 to District R-1a. (6056-P-19)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Zoning Ordinance, is hereby amended by enacting a new section to
be known as Section 80-11A0677, rezoning an area of approximately 13 acres
generally located on the west side of M-291 (N.E. Cookingham Drive) between
N.E. 104th Street on the south and N.E. 105th Street on the north from District
CP-2 (Local Planned Business Center) to District R-1a (One-Family Dwellings,
Medium Density), said section to read as follows:
Section 80-11A0677. That an area
legally described as:
A tract of land in
the Southwest Quarter of Section 26, Township 52N, Range 32W, in Kansas City,
Clay County, Missouri, described as follows: Commencing at the Southwest corner
of Section 26; thence South 89 degrees, 32 minutes, 21 seconds East, along the
South line of the Southwest quarter, 984.51 feet; thence North 22 degrees, 59
minutes, 10 seconds West, 65.28 feet, to a point on the North line of a tract
recorded as Document N-60826 in Book 2734 at Page 540, and the POINT OF
BEGINNING; thence continuing North 22 degrees, 59 minutes, 10 seconds West,
781.21 feet; thence South 89 degrees, 36 minutes, 08 seconds East, 93.89 feet,
to a curve to the left; thence on curve, tangent to last course, having a
radius of 418.08 feet, and an arc length of 242.52 feet; thence South 89
degrees, 36 minutes, 08 seconds East, 374.07 feet, to the existing Westerly
Right-Of-Way of Missouri Route 291; thence Southerly, along the Right-Of-Way,
to following three courses: South 23 degrees, 00 minutes, 16 seconds East,
113.13 feet, North 66 degrees, 59 minutes, 44 seconds East, 20.00 feet, South
23 degrees, 00 minutes, 16 seconds East, 752.08 feet, to a point on the North
line of a tract recorded as Document N-60826 in Book 2734 at Page 540; thence
North 89 degrees, 32 minutes, 21 seconds West, along the North line, 749.10
feet, to the point of beginning, containing 13.04 acres, more or less.
is hereby rezoned from District
CP-2 (Local Planned Business Center) to District R-1a (One-Family Dwellings,
Medium Density), all as shown outlined on a map marked Section 80-11A0677,
which is attached hereto and made a part hereof, and which is hereby adopted as
a part of an amendment to the zoning maps constituting a part of said chapter
and as an amendment to Section 80-11 thereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
