Amending a previously approved development
plan in District R-2.5 on approximately a 3.73 acre tract of land generally
located on the south side of Wilson Avenue between Wallace Avenue to the east
and Marsh Avenue to the west by allowing for the construction of an athletic
field and basketball court. (9277-P-6).
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section A. That an
amendment to a previously approved development plan in District R-2.5
(Residential 2.5) on approximately a 3.73 acre tract of land generally located
on the south side of Wilson Avenue between Wallace Avenue to the east and Marsh
Avenue to the west, and more specifically described as follows:
Lots 1 thru 12 and 26 thru 31, Block 26 and adjacent
platted 14 foot alley, together with Lots 4 thru 6, Block 9, Washington, a
platted subdivision of land in the City of Kansas City, Jackson County, Missouri.
is hereby approved, subject to
the following conditions:
1. The developer shall limit fencing to a maximum of 6 feet in
the rear and 4 feet in front yards.
2.
No uses/structures are approved for Lot 6 as part of this application.
3.
Applicant shall amend the plan prior to any use/structures on Lot 6.
4.
The developer shall submit a storm drainage analysis from a
Missouri-licensed civil engineer to the Land Development Division evaluating
proposed improvements and impact to drainage conditions. Since this
project is within a "Combined Sewer Overflow" (CSO) district, the
project shall be designed to retain rainfall of 1.5 inch depth over the project
site to simulate natural runoff conditions and reduce small storm discharge to
the combined sewer system and manage the 10-year storm and 100-year storm per
currently adopted APWA standards. The analysis shall be submitted prior
to issuance of any building permits, and the developer shall secure permits to
construct any improvements required by the Land Development Division prior to
issuance of any certificate of occupancy.

The developer shall obtain permits from the Land Development Division to
construct sidewalks along the Wilson Avenue frontage across the Donnelly Avenue
right-of-way.
6.
The developer shall obtain the executed and recorded City approved
grading, temporary construction, drainage/sewer, or any other necessary
easements from the abutting property owner(s) that may be required prior to
submitting any public improvements crossing properties not controlled by the
developer and include said document(s) within the public improvement
applications submitted for permitting.
7.
The developer shall provide acceptable easements for any deep sewers
where proposed fill is added or where the sewer will be further obstructed by
surface improvements and that a structural analysis be provided to confirm
adequate structural integrity for the proposed loading conditions of this plan,
and secure permits and provide City approved executed and recorded easement
prior to adding fill or constructing surface obstructions as required by the Land Development Division.
A copy of said development plan
is on file in the office of the City Clerk with this ordinance and is made a
part hereof.
Section B. That the Council finds and
declares that before taking any action on the proposed amendment hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
