COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 940123

 

Amending Chapter 26, Code of General Ordinances of Kansas City, Missouri, by enacting one new section, Section 26.100, making it unlawful for any person to stalk another person.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 26, Code of General Ordinances of Kansas City, Missouri, is amended by enacting one new section to read as follows:

 

Section 26.63. Stalking.

 

(a) It shall be unlawful for any person to stalk another person.

 

(b) The term "stalk" means to purposely and repeatedly harass or follow with the intent of harassing another person.

 

(c) The term "harass" means engaging in a knowing course of conduct directed at a specific person that serves no legitimate purpose, that would cause a reasonable person to suffer substantial emotional distress, and that actually causes substantial emotional distress to that person.

 

(d) The term "course of conduct" means a pattern of conduct composed of a series of acts over a period of time, however short, evidencing a continuity of purpose. Constitutionally protected activity is not included within the meaning of "course of conduct".
