ORDINANCE NO. 001072

 

Authorizing the Director of Housing and Community Development to enter into a Cooperative Agreement with the Missouri Highways and Transportation Commission to accept Congestion Mitigation and Air Quality Funds in the amount of $200,000.00 (CMAQ-3300(464)) allocated to the Riverfront Heritage Trail, and to enter into a Cooperative Agreement with the Port Authority of Kansas City, Missouri, which will assign this grant to the Port Authority to perform the obligations thereunder; and directing the City Clerk to record the agreements.

 

WHEREAS, the Missouri Highways and Transportation Commission has awarded the City of Kansas City, Missouri, Congestion Mitigation and Air Quality Funds (CMAQ) in the amount of $200,000.00 for the planning and design of the Riverfront Heritage Trail, Federal Aid Project No. CMAQ-3300(464); and

 

WHEREAS, the City of Kansas City, Missouri, wishes to enter into a Cooperative Agreement with the Missouri Highways and Transportation Commission whereby it accepts that grant award and also wishes simultaneously to enter into a Cooperative Agreement with the Port Authority of Kansas City, Missouri, whereby it assigns those CMAQ funds and obligations to the Port Authority, which has agreed to contribute the required local match of $40,000.00 and which will complete the Planning and Design Contract - Phase I for the Kansas City Riverfront Heritage Trail System; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Housing and Community Development, on behalf of the City, is hereby authorized to enter into a Cooperative Agreement with the Missouri Highways and Transportation Commission, whereby the City of Kansas City, Missouri, accepts CMAQ funding in the amount of $200,000.00 for the Riverfront Heritage Trail project, Federal Aid Project No. CMAQ-3300(464).

 

Section 2. That the Director of Housing and Community Development, on behalf of the City, is hereby authorized to enter into a Cooperative Agreement with the Port Authority of Kansas City, Missouri. That agreement assigns the above-referenced CMAQ funds and accompanying obligations to the Port Authority, which agrees to complete the responsibilities, terms and conditions of the CMAQ funds agreement on behalf of the City.

 

Section 3. That the City Clerk is hereby directed to record copies of the Cooperative Agreements in the office of the Secretary of State for the State of Missouri, and in the office of the Director of Records for Jackson County, Missouri at Kansas City as required by Section 70.300 of the Revised Statutes of Missouri.
