ORDINANCE NO. 970900

 

Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 80-11A0038, rezoning an area of approximately 12.39 acres generally located on the east side of Holly Street on both sides of 20th Street from District R-4 (Low Apartments) to District URD (Urban Redevelopment District), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0038, rezoning an area of approximately 12.39 acres generally located on the east side of Holly Street on both sides of 20th Street from District R-4 (Low Apartments) to District URD (Urban Redevelopment District), said section to read as follows:

 

Section 80-11A0038. That an area legally described as:

 

TRACT I: All of Block 1 of Pennway Plaza, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT II: All of Block 2 of Pennway Plaza, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT III: All of Block 3 of Pennway Plaza, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT IV: Lot 1, Block 4 as shown on the Certificate of Survey of Pennway Plaza, a subdivision in Kansas City, Jackson County, Missouri, filed May 1, 1996, as Document No. I-0018811 in Book S-5 at page 60.

 

TRACT V: Lot 1, Block 5, as shown on the Certificate of Survey of Pennway Plaza, a subdivision in Kansas City, Jackson County, Missouri, filed May 1, 1996, as Document No. I-0018812 in Book S-5 at page 61.

 

TRACT VI: Lot 1, Block 6, as shown on the Certificate of Survey of Pennway Plaza, a subdivision in Kansas City, Jackson County, Missouri, filed May 1, 1996, as Document No. I-0018813 in Book S-5 at page 62.

 

Execpt that part of Lot 1, Block 4, as shown on the Certificate of Survey of Lot Split for Pennway Plaza Block 4, as recorded in Kansas City, Jackson County, Missouri, lying south of a line starting at a certain point A, and thence from point A, South 87 41'31" East to the intersection of said line with Belleview Avenue, where point A is 303.20 feet North 02 25'08" East of the southwest corner of Block 4.

 

is hereby rezoned from District R-4 (Low Apartments) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 80-11A0038, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval and that the developer make any necessary

improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer petition for the vacation of portions of Belleview Avenue, Pennway Terrace and 20th Street.

 

6. That the developer construct a cul-de-sac on Belleview Avenue at the 20th Street right of way as required by the Department of Public Works.

 

7. That the developer improve Belleview Avenue to collector street standards as required by the Department of Public Works.

 

8. That the developer improve Holly Street to collector street standards as required by the Department of Public Works.

 

9. That the developer improve Pennway Terrace to collector street standards as required by the Department of Public Works.

 

10. That the developer extend water mains as required by the Water Services Department.

 

11. That the developer extend sanitary sewers as required by the Department of Public Works.

 

12. That the developer submit a street tree planting plan with the final plat to the City Forester for approval which includes spacing, species and size of street trees.

 

13. That the developer submit a site plan for each phase to the Director of the Department of City Development for approval prior to the issuance of a building

permit. The site plans shall include: development plan information, property uses,

setback distances, lighting, landscaping, signage and architectural characteristics.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 970900, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
