Approving an amendment to a previously approved
preliminary plan in District CP-2 (Local Planned Business Center) on
approximately a 7.1 acre tract of land generally located on the east side of
Interstate 29, at N. Montclair Street and N. Roanridge Road (to be extended).

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved preliminary plan in District CP-2 (Local Planned Business Center) on
approximately a 7.1 acre tract of land generally located on the east side of
Interstate 29, at N. Montclair Street and N. Roanridge Road (to be extended),
and more specifically described as follows:
A tract of land situated in the Northwest Quarter of
Section 18, Township 51, Range 33, Kansas City, Platte County, Missouri,
more particularly described as follows: Commencing at the northwest corner
of the Northwest Quarter of Section 18, Township 51, Range 33; thence
South 89 07'22" East, along the north line of said Northwest Quarter,
a distance of 2629.03 feet; thence South 00 26'29" West, along the
east line of said Northwest Quarter, a distance of 2448.88 feet to a point on
the south city limit line of Kansas City, Missouri; thence North 89
10'12" West, a distance of 1421.14 feet, along said south city limit
line of Kansas City, Missouri, to a point on the east right of way of U.S.
Route I-29; thence along said east right of way of U.S. Route I-29, North
34 20'38" West, a distance of 288.18 feet, to the true point of
beginning of the tract of land herein described; thence northerly along
the west right of way line of N. Montclair Street, on a curve to the right
having a radius of 380.00 feet, a central angle of 30 18'37", and
whose initial tangent bears North 03 31'11" East, an arc distance of
201.03 feet to a point of tangency; thence North 33 49'48" East,
along the west right of way line of N. Montclair Street, a distance of
240.78 feet; thence northerly on a curve to the left, along the west right of
way line of N. Montclair Street, having a radius of 1060.00 feet, a
central angle of 21 15'18", and whose initial tangent bears North 33
49'48" East, an arc distance of 393.23 feet, to an ending tangent
bearing of North 12 34'30" East; thence North 84 54'33" West, a
distance of 441.30 feet; thence South 59 21'24" East, a distance of 365.00
feet to a point on said east right of way of U.S. Route I-29; thence
southerly along the east right of way of U.S. Route I-29, on a curve to
the left, having a radius of 2682.79 feet, a central angle of 4
09'52"; and whose initial tangent bears South 30 10'46" East, an
arc distance of 190.00 feet, to a pont of tangency; thence South 34
20'38" West, a distance of 527.89 feet, to the true point of
beginning, containing 7.06 acres, more or less.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for approval and that the
developer construct any improvements as required by the City
Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
5. That the developer secure the approval of the
Missouri Highway and Transportation Department prior to working
within any State right of way.
6. That the developer grant a Noise and Aviation
Easement to the City.
7. That the developer contribute approximately
$57,800.00 for the improvement of N. Roanridge Road south of the
site, at the rate of $1.80 per square foot of retail
commercial use; $1.00 per square foot of office
space; and $2.50 per square foot of
restaurant use.
8. That the developer receive the approval of the
Missouri Highway and Transportation Department for access locations
onto N. Roanridge Road.
9. That the developer provide for a truck loading
and unloading dock on the premises.
10. That the developer extend water mains as
required by the Water Services Department.
11. That the developer extend sanitary sewers as
required by the Department of Public Works.
12. That the developer provide for fire protection
as required by the Fire Department.
13. That the developer dedicate additional right of
way for N. Roanridge Road as required by the Department of Public
Works so as to provide 60 feet of right of way
for N. Roanridge Road.
14. That the developer construct N. Roanridge Road
to collector street standards along the property's west property
line.
15. That the developer submit a final plan to the
City Plan Commission for approval, including plans for signage and
landscaping. The landscaping plan shall show
adequate area for planting of trees and shrubs
within the parking lot.
A copy of said amendment is on file in the office of the
City Clerk under Document No. 960510, which is attached hereto and made a part
hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
