COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 940712

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2528, rezoning an area of 1.54 acre bounded by 43rd Street, Roanoke Road, Archibald Street, Clark Avenue, and the rear lot lines along Clark Avenue from District R-5 (High Apartment) to District PD/R-5 (Planned District/High Apartment), and approving a development plan for the same. (10645-PD-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2528, rezoning an area of 1.54 acre bounded by 43rd Street, Roanoke Road, Archibald Street, Clark Avenue, and the rear lot lines along Clark Avenue from District R-5 (High Apartment) to District PD/R-5 (Planned District/High Apartment), said section to read as follows:

 

Section 65.010A2528. That an area legally described as:

 

Lot No. 1, Westport Plaza Place; Lot Nos. 31 and 32, the east 35 feet of Lot 30 and one-half of vacated alley adjoining to and southeasterly of said lots; the west 284 feet of the 50 foot right of way of Archibald Street commencing at Roanoke Road, all lying within Kansas City, Jackson County, Missouri.

 

is hereby rezoned from District R-5 (High Apartment) to District PD/R-5 (Planned District/High Apartment), all as shown outlined on a map marked Section 65.010A2528, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office and construct improvements as

required.

 

3. That the developer submit a plan for grading and siltation and erosion control to the City Engineer's

Office prior to the commencement of construction.

 

4. That the developer contribute money in lieu of parkland in the amount of $10,486.80, based upon 139 multi-family

units at the 1993 average cost per acre of $6,287.05.

 

5. That the developer dedicate additional right of way for Clark Avenue as required by the City Engineer's Office.

 

6. That the developer improve Clark Avenue as required by the City Engineer's Office.

 

7. That the developer dedicate 15 feet of additional right of way for W. 43rd Street to provide a total of 40 feet

from centerline.

 

8. That the developer widen W. 43rd Street for a total width of 32 feet from centerline and construct new sidewalks at

the time of initiation of Phase II.

 

9. That the developer construct sidewalks and curbs along the Roanoke Road frontage at the initiation of Phase II.

 

10. That the developer extend water mains as required by the City Water Department.

 

11. That the developer provide fire protection as required by the Fire Marshal's Office.

 

12. That the developer secure a variance from the Board of Zoning Adjustment in accordance with Section 39.444 of

the Zoning Ordinance; provided, that if the proposed use

should change from elderly that the requirements of

Section 39.444 shall be met in total.

 

13. That the developer submit elevation drawings, including facade designs and building materials, to the Director of

the Department of City Development for approval prior to

the issuance of a building permit.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 940712, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
