ORDINANCE NO. 990205

 

Repealing Section 1 of Ordinance No. 981002, passed August 20, 1998; authorizing the condemning and taking private property in fee simple for public use for Kansas City International Airport expansion; and enacting in lieu thereof a new section of like number and subject matter.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Section 1 of Ordinance No. 981002, passed August 20, 1998, is hereby repealed and a new Section 1 is enacted as follows:

 

Section 1. That the following tract of land is hereby condemned and taken in fee simple for the public use for the expansion of Kansas City International Airport. The tract is legally described as follows:

 

TRACT 60: A tract of land in the Southwest Quarter of Section 10 and the Northwest Quarter and the Northeast Quarter of Section 15, all in Township 52, Range 34, in Kansas City, Platte County, Missouri, and all being more particularly described as follows: Beginning at a point on the south line of the Northeast Quarter of Section 15, said point being 1854.60 feet west of the southeast corner of the Northeast Quarter of said Section 15, said point of beginning being also the southwest corner of the tract of land conveyed to Henry L. Dillingham by Deed recorded March 15, 1921, in Book 92 at page 267 in the Office of the Recorder of Deeds, Platte County, Missouri; thence South 8952'58" West along the south line of the Northeast Quarter of said Section 15, a distance of 780.59 feet to the southeast corner of the Northwest Quarter of said Section 15; thence South 8930'43" West along the south line of the Northwest Quarter of said Section 15 a distance of 1003.08 feet; thence North 7935'43" West a distance of 477.18 feet to a point which is 1109.46 feet east of the west line of the Northwest Quarter of said Section 15; thence North 003'26" West along a line parallel to and 1109.46 feet east of the west line of the Northwest Quarter of said Section 15 and the west line of the Southwest Quarter of said Section 10, a distance of 3345.24 feet to a point on the southwesterly right of way line of the State Highway now designated Interstate Route No. 29, said southwesterly right of way being also the southwesterly right of way line established in a right of way deed to the State of Missouri recorded October 8, 1951, in Book 166 at page 631 in Office of the Recorder of Deeds, Platte County, Missouri; thence continuing North 003'26" West along a line parallel to and 1109.46 feet east of the west line of the Southwest Quarter of said Section 10 to a point on the centerline of the public road formerly known as Liberty and Platte City Public Road; thence southeasterly along the centerline of said Public Road to a point of intersection with the northerly prolongation of a straight line drawn North 016'25" East from the point of beginning, said point of intersection being also the point of intersection of the centerline of said Public Road with the west line of the tract of land conveyed to Henry L. Dillingham by Deed recorded March 15, 1921, in Book 92 at page 267 in


the Office of the Recorder of Deeds, Platte County, Missouri; thence in a straight line South 016'25" West to a point on the southwesterly right of way line of said State Highway now designated Interstate Route No. 29, said southwesterly right of way line being also the southwesterly right of way line established in said right of way deed to the State of Missouri, recorded October 8, 1951, in Book 166 at page 631 in the Office of the Recorder of Deeds, Platte County, Missouri; thence continuing in a straight line South 016'25" West a distance of 1874.17 feet to the point of beginning. Subject to easements, reservations, restrictions and other matters of record.
